Respondents \n\n \n\n=========================================================\n \nAppearance\n: \nMRS\nVASAVDATTA BHATT for\nthe Appellant.  \nMR MAHESH B SHAH \/ MR KUNAL M SHAH for the\nRespondents.\n \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE H.B.ANTANI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 17\/03\/2008 \n\n \n\n \nORAL\nJUDGMENT<\/pre>\n<p>1.\t\tOn<br \/>\n05-02-2000, while Pankajkumar Rupchand Shah was travelling from<br \/>\nPalanpur to Falna by Bandra-Bikaner Express, he fell down from the<br \/>\ntrain near Maval Station and died on the spot.  On account of the<br \/>\ndeath of deceased Pankajkumar Rupchand Shah, his heirs preferred<br \/>\nclaim petition being Case No. TA0100004 before the Railway Claims<br \/>\nTribunal claiming compensation from the Railways.  By judgment and<br \/>\norder dated 14-02-2007, the Tribunal allowed the petition and awarded<br \/>\ninterest from the date of the petition till realization.  Being<br \/>\naggrieved by the interest part of the order, the appellant ?<br \/>\nRailways is in appeal under Section 23 of the Railway Claims Tribunal<br \/>\nAct, 1987.\n<\/p>\n<p>2.\t\tIt<br \/>\nis contended by the learned Advocate Ms. Vasavdatta Bhatt on behalf<br \/>\nof the appellant ?  Railways that the Tribunal has in some cases<br \/>\nawarded interest from the date of the petition till realization and<br \/>\nin some cases, it has also awarded interest from the date of the<br \/>\naward till realization.  This lacunae is glaring and, therefore, it<br \/>\nis submitted by the learned Advocate for the appellant that interest<br \/>\nbe awarded from the date of the award and not from the date of the<br \/>\npetition.  The learned Advocate has placed reliance on the judgment<br \/>\nrendered in First Appeal No. 24 of 2002 in support of her submissions<br \/>\nat the Bar.\n<\/p>\n<p>\t\tIt<br \/>\nis also submitted that while computing the period for awarding the<br \/>\ninterest, the Tribunal has wrongly taken into consideration the<br \/>\nperiod for which the Tribunal did not function and, therefore, the<br \/>\nTribunal was not justified in awarding interest for the said period.\n<\/p>\n<p>\t\tWith<br \/>\nregard to the award of compensation made in favour of the claimants,<br \/>\nthe learned Advocate has not disputed the same.\n<\/p>\n<p>3.\t\tLearned<br \/>\nAdvocate Mr. Mahesh B. Shah representing the claimants ?<br \/>\nrespondents vehemently submitted that the Tribunal has passed just<br \/>\nand proper award in favour of the claimants to the tune of Rs. 4<br \/>\nLakhs and the interest at the rate of 6% is awarded from the date of<br \/>\nthe petition till the realization and it does not call for any<br \/>\ninterference in appeal preferred by the appellant.  The learned<br \/>\nAdvocate submitted that even the interest awarded at the rate of 6%<br \/>\nis not excessive and, therefore, the same cannot be reversed in an<br \/>\nappeal preferred by the appellant.  In view of the aforesaid facts<br \/>\nand circumstances of the case, the learned Advocate submitted that<br \/>\nthe appeal requires to be dismissed.\n<\/p>\n<p>4.\t\tHeard<br \/>\nlearned Advocate Ms. Vasavdatta Bhatt for the appellant and learned<br \/>\nAdvocate Mr. Mahesh B. Shah for the respondents at length and in<br \/>\ngreat detail.  I have also perused the judgment and award  dated<br \/>\n14-02-2007 passed by the Railway Claims Tribunal, Ahmedabad Bench,<br \/>\nAhmedabad.\n<\/p>\n<p>5.\t\tThe<br \/>\ndistraught heirs of deceased Pankajkumar Rupchand Shah had preferred<br \/>\npetition before the Claims Tribunal claiming compensation for the<br \/>\naccidental death of deceased Pankajkumar Rupchand Shah.  The death in<br \/>\nquestion took place on 05-02-2000 when said Pankajkumar Rupchand<br \/>\nShah, who was travelling in a train from Palanpur to Falna, fell down<br \/>\nfrom the train near Maval Station and died on the spot.  The<br \/>\naccident, as per the discussion by the Claims Tribunal, was rightly<br \/>\nproved by the claimants on the basis of documentary evidence as well<br \/>\nas oral deposition.  Considering the fact that accident took place,<br \/>\nthe Tribunal has awarded compensation as contemplated in Part I of<br \/>\nthe Schedule in view of  Rule 3 of the Railway Accident And Untoward<br \/>\nAccidents Compensation Rules, 1990 to the extent of Rs. 4 Lakhs.<br \/>\nConsidering the entire gamut of oral deposition and the documentary<br \/>\nevidence, no interference is called for in the present appeal.\n<\/p>\n<p>\t\tThe<br \/>\ncontention raised by the learned Advocate for the appellant that<br \/>\ninterest should be awarded from the date of the award till the<br \/>\nrealization and not from the date of the petition till the<br \/>\nrealization is stated to be rejected.  Even the judgment rendered by<br \/>\nthe Division Bench of this Court in First Appeal No. 24 of 2002, on<br \/>\nwhich reliance is placed by the learned Advocate, also does not help<br \/>\nthe learned Counsel in any manner whatsoever because the Division<br \/>\nBench has taken a view that the interest is to be awarded from from<br \/>\nthe date of the petition till the realization.  Therefore, the<br \/>\ncontention raised by the learned Counsel requires to be rejected.\n<\/p>\n<p>\t\tThe<br \/>\nsecond contention raised by the learned Advocate is that the Railway<br \/>\nClaims Tribunal does not sit for the whole year on regular basis and,<br \/>\ntherefore, the interregnum period, during which the Railway Claims<br \/>\nTribunal is not functioning, cannot be taken into consideration for<br \/>\ncalculating and awarding interest to the claimants.  This submission<br \/>\nalso has no force as the claimants should not suffer on account of<br \/>\nnon-functioning of the Railway Claims Tribunal for a particular<br \/>\nperiod.\n<\/p>\n<p>\t\tIn<br \/>\nview of the foregoing discussion, no interference is required to be<br \/>\ncalled for in the appeal preferred by the appellant.  Hence, the same<br \/>\nis liable to fail.\n<\/p>\n<p>6.\t\tIn<br \/>\nview of the foregoing discussion, the appeal is dismissed.\n<\/p>\n<p>[H.\n<\/p>\n<p>B.
