NO. 14353 OF 2008 H\n                 --------------------------------------\n                  Dated this the 2nd June, 2008\n\n                           JUDGMENT\n<\/pre>\n<p>      Petitioner has retired from the service of the respondent<\/p>\n<p>Corporation while working as a Mechanic on 30.11.2007. His<\/p>\n<p>complaint is that he has not received his pension and other<\/p>\n<p>retirement benefits. Today, when the matter came up, learned<\/p>\n<p>counsel for petitioner has produced before me an order dated<\/p>\n<p>24.5.2008 issued by the Executive Director (Vigilance),<\/p>\n<p>KSRTC. Therein, it is, inter alia, stated as follows:<\/p>\n<blockquote><p>             &#8220;I have gone through the entire file in<\/p>\n<p>        detail. In view of the finding in the enquiry and<\/p>\n<p>        re-enquiry, further action against Shri V.M.<\/p>\n<p>        Asharaf, Mechanic, North Paravoor is dropped.<\/p>\n<p>        Period under suspension is treated as duty.&#8221;<\/p><\/blockquote>\n<p>      2. There is reference made to the detailed enquiry and the<\/p>\n<p>Enquiry Officer found the petitioner not guilty and in the re-<\/p>\n<p>enquiry also, it was found that he was not guilty. I heard the<\/p>\n<p><span class=\"hidden_text\">WPC. 14353\/08 H                  2<\/span><\/p>\n<p>learned standing counsel appearing for the respondent<\/p>\n<p>Corporation also. I feel that in the light of this development, the<\/p>\n<p>claim of the petitioner for grant of retirement benefits, like<\/p>\n<p>Pension, Provident Fund and Staff Welfare Fund should receive<\/p>\n<p>the attention of the second respondent. Accordingly, the Writ<\/p>\n<p>Petition is disposed of directing the second respondent to<\/p>\n<p>consider the claim of the petitioner for grant of Pension,<\/p>\n<p>Provident Fund as also Staff Welfare Fund.             The second<\/p>\n<p>respondent shall take a decision in the matter in accordance with<\/p>\n<p>law, within a period of one month from the date of receipt of a<\/p>\n<p>copy of this Judgment, and the amounts found due, shall be<\/p>\n<p>disbursed to the petitioner within a period of one month<\/p>\n<p>thereafter. Petitioner will also be entitled to statutory interest on<\/p>\n<p>the Provident Fund amount from the due date till the date of<\/p>\n<p>payment.\n<\/p>\n<\/p>\n<p>                                       K.
