Rekhi VS DDA\n                                                                                Dated : 22.2.2010\n\n       This is in continuation of this Commission's proceedings dated 20.1.2010.\nAs scheduled, the matter is called for hearing today dated 22.2.2010. Appellant\npresent. DDA is represented by Shri Bhim Singh, Asstt. Director. It is the\nprincipal submission of the appellant that the Gurudwara situate on Plot No 05,\nNizammudin East, New Delhi, has not been regularized by DDA despite the\norders of the Lt Governor of Delhi. He, therefore, wishes to know the reasons for\nnon-implementation of the Lt Governor's order.\n\n2.      On the other hand, Shri Bhim Singh would submit that an alternative plot\ni.e. No 8 was allotted to the appellant party and that the LG's order could not be\nimplemented consequent upon the adverse order of Hon'ble Delhi High Court.\n\n3.      It is not for the Commission to go into the merits of the case. If the order\nof the Lt Governor has not been implemented, it is for the appellant to agitate the\nmatter before the Lt Governor. However, the Commission has obligation to\nprovide full access to the documents being maintained by DDA in this respect.\nThe appellant submits that he has already carried out inspection of the relevant\ndocuments. He will be at liberty to take fresh inspection of documents, if he is so\ninclined. Besides, Shri Bhim Singh, Asstt Director, DDA, is hereby directed to\nprovide copies of file notings containing the order of LG for regularization of\nGurudwara at plot No 5 and also other collateral documents in this respect.\n\n4.
