SHAH\n\t\t\n\t\n\n \n\nDate\n: 05\/02\/2009 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>By<br \/>\n\tway of this petition under Article 226 of the Constitution of India,<br \/>\n\tpetitioner who was at the relevant time serving as Stretcher Boy in<br \/>\n\tCivil Hospital, Nadiad has prayed for an appropriate writ, direction<br \/>\n\tand\/ or order quashing and setting aside the impugned order dated<br \/>\n\t31.3.2008, by which the petitioner is removed from service.\n<\/p>\n<p>A<br \/>\n\tdepartmental inquiry came to be initiated against the petitioner for<br \/>\n\tremaining unauthorized absent from duty since 1992 and he had taken<br \/>\n\tliquor on duty. As the criminal case was pending against the<br \/>\n\tpetitioner with respect to offence punishable under Prohibition Act<br \/>\n\tand there was a gross delay in concluding the trial, therefore, the<br \/>\n\tdepartment proceeded with departmental inquiry subject to reviewing<br \/>\n\tthe order considering the outcome of the trial for the offence under<br \/>\n\tProhibition Act. After the departmental inquiry, charges levelled<br \/>\n\tagainst the petitioner with respect to remaining unauthorized absent<br \/>\n\tsince 1992 till date also came to be proved and the Disciplinary<br \/>\n\tAuthority by impugned order dated 30.3.2008 removed the petitioner<br \/>\n\tfrom service. Being aggrieved and dissatisfied with said order of<br \/>\n\tremoval as such the petitioner has already preferred appeal before<br \/>\n\tthe appropriate authority. Still, the petitioner has preferred the<br \/>\n\tpresent Special Civil Application challenging the very order of<br \/>\n\tremoval for which the appeal is preferred and the learned advocate<br \/>\n\tfor the petitioner has addressed the Court on merits challenging the<br \/>\n\timpugned order of removal from service.\n<\/p>\n<p>Shri<br \/>\n\tHemant Dave, learned advocate for the petitioner has submitted that<br \/>\n\tInquiry Officer and Authority has erred in proceeded further with<br \/>\n\tthe inquiry during the pendency of the Criminal proceedings against<br \/>\n\tthe petitioner for the offence under Prohibition Act.  It is<br \/>\n\tsubmitted that as such the petitioner came to be acquitted by the<br \/>\n\tlearned trial Court vide judgment and order dated 4.4.2008 and the<br \/>\n\tpetitioner came to be removed on 31.3.2008. So far as the charges<br \/>\n\tagainst the petitioner that petitioner has remained unauthorized<br \/>\n\tabsent since 1992 is concerned Shri Dave, learned advocate for the<br \/>\n\tpetitioner has submitted that as such petitioner was not permitted<br \/>\n\tto resume duty and in fact even petitioner was on duty on 31.7.1992,<br \/>\n\t1.8.1992 and 2.08.1992 as averred in para 7 in the petition.<br \/>\n\tTherefore, it is requested to allow the present Special Civil<br \/>\n\tApplication.\n<\/p>\n<p>Having<br \/>\n\theard the learned advocate for the petitioner and considering the<br \/>\n\timpugned order, it appears that petitioner is dismissed from the<br \/>\n\tservice after holding departmental inquiry for misconduct of<br \/>\n\tremaining unauthorized absent since 1992. It is true that petitioner<br \/>\n\tis also dismissed  from the service for misconduct of taking liquor<br \/>\n\ton duty. Considering the fact that petitioner was unauthorizedly<br \/>\n\tabsent since 1992, in the facts and circumstance of the case, it<br \/>\n\tcannot be said that the Inquiry Officer and the Disciplinary<br \/>\n\tAuthority has committed any error and\/or illegality in proceeding<br \/>\n\tfurther with the inquiry. Even otherwise, as the charge against the<br \/>\n\tpetitioner for remaining unauthorized absent from 1992 has been<br \/>\n\tproved and considering the fact that petitioner was serving in<br \/>\n\tHospital such a indiscipline in the hospital cannot be tolerated.<br \/>\n\tUnder the circumstances, it cannot be said that the impugned order<br \/>\n\tpassed by the authority is so arbitrary and\/ or illegal which calls<br \/>\n\tfor interference of this Court. In the facts and circumstances of<br \/>\n\tthe case and looking to the charges levelled against the petitioner,<br \/>\n\tthe petitioner who was serving as Stretcher Boy in Civil Hospital<br \/>\n\tand looking to the alleged misconduct petitioner cannot be continued<br \/>\n\tin the hospital. It will not be in the interest of the patients and<br \/>\n\tpublic at large to continue the petitioner in service.
