Act, Court No.6) Ahmedabad in Criminal<br \/>\nCase No.1631 of 2009.\n<\/p>\n<p>\tLearned<br \/>\nadvocate Mr. Bhoharia appearing on behalf of the appellant that the<br \/>\nlearned trial Judge has committed grave error in passing the order of<br \/>\nacquittal of the accused. He submitted that learned Magistrate has<br \/>\nwrongly held that the complainant has filed to prove legal debt and<br \/>\nalso completely overlooked the evidence of the complainant. The<br \/>\naccused has not disputed about his signature upon the cheque. He<br \/>\nfurther submitted that in such kind of offence, the accused cannot be<br \/>\nacquitted, but the learned Magistrate by ignoring the evidence, has<br \/>\nacquitted the accused.\n<\/p>\n<p>\tHeard<br \/>\nlearned APP Mr. Jani for the respondent &#8211; State.\n<\/p>\n<p>\tThe<br \/>\ncomplainant has not kept the account for borrowing the money to the<br \/>\naccused nor he has kept any note about the said money. There is no<br \/>\nagreement or writing for the said money and it is not stated in the<br \/>\nreturn of Income-Tax.
