The State\nBank of Patiala, through Authorised Officer, Assets Recovery Branch, 99-107, Sector-8,\nChandigarh;2. The Branch Manager, State Bank of Patiala, Dhulkot Branch, Ambala City on\n28\/7\/2009, applicant till date have not received any correspondence regarding the same from the\nrespondent's end. Please provide applicant information status detail of the above mentioned matters\nand reasons why no correspondence as well listing of the same has been yet made.\n\nReply:\nIt is pertinent to mention here that SA No. 80\/2009 filed by you has already been disposed off in your\npresence vide order dated 22\/05\/2009 passed by Hon'ble Presiding Officer, Debts Recovery Tribunal-\nI, Chandigarh. It seems that there has been no appeal filed by the appellant.\nAs regards appellant's present application dated 19\/05\/2010, it is obvious that any penalty for non-\ncompliance of RBI U\/s 28 SARFAESI act,2002, no court below the court of metropolitan Magistrate\nor Judicial Magistrate of the first class is empowered to take cognizance of offence U\/S 30 of\nSARFAESI Act and to try an offence punishable under this Act. Therefore, the present application\ndoes not fall under the jurisdiction of CPIO &amp; therefore the appellant is at liberty to approach the\ncompetent authority in this regard.\n\nGrounds for the First Appeal\/ Complaint:\nInformation given by the PIO is not satisfactory.\n\nOrder of the First Appellate Authority (FAA):\nNo Order.\n Ground of the Second Appeal:\nUnsatisfactory reply by the PIO and No Order by the FAA.\n\nRelevant Facts<\/pre>\n<p> emerging during Hearing:\n<\/p>\n<p>The following were present<br \/>\nAppellant: Mr. Paramjit Singh Gill on video conference from NIC-Ambala Studio;<br \/>\nRespondent: Mr. Vijay Sharma, CPIO &amp; Section Officer on video conference from NIC-Chandigarh;\n<\/p>\n<p>       The PIO has given the information but the Appellant wants cause list of the date on which his<br \/>\ncase was listed.\n<\/p>\n<p>Decision:\n<\/p>\n<p>The Appeal is allowed.\n<\/p>\n<p>      The PIO is directed to provide an attested photocopy of the cause list of the day<br \/>\non which the Appellant&#8217;s case was listed.
