No.44175 of 2010\n                  SONE CHAUDHARY, SON OF LATE BASANT CHOUDHARY\n                                            Versus\n                                  THE STATE OF BIHAR\n                                          -----------\n<\/pre>\n<p>2.   15.03.2011                Heard learned counsel for the petitioner and the<\/p>\n<p>                  State.\n<\/p>\n<p>                               The petitioner seeks bail in a case instituted for the<\/p>\n<p>                  offence under Sections 302\/34 of the Indian Penal Code.<\/p>\n<p>                               It has been submitted that there is a counter version<\/p>\n<p>                  of the present occurrence and the deceased died on the next<\/p>\n<p>                  date.\n<\/p>\n<p>                               Considering the same, let the petitioner above<\/p>\n<p>                  named, be released on bail on furnishing bail bond of Rs.<\/p>\n<p>                  5,000\/- (Five thousand) with two sureties of the like amount<\/p>\n<p>                  each or any other surety to be fixed by the court concerned to<\/p>\n<p>                  the     satisfaction   of   Second   Additional   Sessions   Judge,<\/p>\n<p>                  Nawadah, in Sessions Trial No. 439 of 2010\/473 of 2010 arising<\/p>\n<p>                  out of Nawadah Town P.S. Case No. 226 of 2010 subject to the<\/p>\n<p>                  following conditions: (i)That one of the bailors will be a close<\/p>\n<p>                  relative of the petitioner who will give an affidavit giving<\/p>\n<p>                  genealogy as to how he is related with the petitioner. The bailor<\/p>\n<p>                  will undertake to furnish information to the court about any<\/p>\n<p>                  change in address of the petitioner. (ii)That the affidavit shall<\/p>\n<p>                  clearly state that the petitioner is not an accused in any other<\/p>\n<p>                  case and if he is, he shall not be released on bail. (iii)That the<\/p>\n<p>                  bailor shall also state on affidavit that he will inform the court<br \/>\n<span class=\"hidden_text\">                             2<\/span><\/p>\n<p>        concerned if the petitioner is implicated in any other case of<\/p>\n<p>        similar nature after his release in the present case and<\/p>\n<p>        thereafter the court below will be at liberty to initiate the<\/p>\n<p>        proceeding for cancellation of bail on the ground of misuse.<\/p>\n<p>        (iv)That the petitioner will give an undertaking that he will<\/p>\n<p>        receive the police papers on the given date and be present on<\/p>\n<p>        date fixed for charge and if he fails to do so on two given dates<\/p>\n<p>        and delays the trial in any manner, his bail will be liable to be<\/p>\n<p>        cancelled for reasons of misuse.
