Justice A.K.BASHEER\n\n Dated :18\/12\/2008\n\n O R D E R\n                              A.K.BASHEER, J.\n             - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n                       CRL.R.P.No.2641 OF 2004\n             - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n            Dated this the 18th day of December, 2008\n\n\n                                    O R D E R\n<\/pre>\n<p>      This revision petition is directed                   against        the order of<\/p>\n<p>remand passed by the Additional District and Sessions (Adhoc)<\/p>\n<p>Fast Track Court-II, Pathanamthitta, in Crl.A.No.39\/1999<\/p>\n<p>directing the trial court to hear the accused on the question<\/p>\n<p>of sentence and dispose of the case in accordance with law.<\/p>\n<p>      2.  Petitioner, who           was working               as Sub Inspector of<\/p>\n<p>Police, was     tried       for     offences punishable under Sections<\/p>\n<p>342,348,232,325 and 506(ii) I.P.C.                  At the conclusion of the<\/p>\n<p>trial, the learned Magistrate found the petitioner guilty under<\/p>\n<p>Sections 342 and 323 I.P.C and he was accordingly convicted<\/p>\n<p>and    sentenced to undergo rigorous imprisonment                             for  six<\/p>\n<p>months for the offence under Section 342 I.P.C and also to pay<\/p>\n<p>a fine of      Rs.5,000\/= and in default, to undergo simple<\/p>\n<p>imprisonment for two months. He was also convicted and<\/p>\n<p>sentenced to undergo rigorous imprisonment for one month and<\/p>\n<p>to pay   a fine of Rs.1,000\/= under Section 323 I.P.C with a<\/p>\n<p>default sentence of simple imprisonment for one month.                              It<\/p>\n<p>was further directed that a sum of Rs.4,000\/- shall be paid to<\/p>\n<p>the complainant, if the fine amount was realised.<\/p>\n<p>      3. The above order was challenged by the petitioner<\/p>\n<p>before the Sessions Court. The learned Sessions Judge                           while<\/p>\n<p>confirming the order of conviction, took the view that the<\/p>\n<p>order of the learned Magistrate could not be sustained in as<\/p>\n<p><span class=\"hidden_text\">                                2<\/span><br \/>\nCrl.R.P.No.2641\/04<\/p>\n<p>much as the accused was not heard on sentence.<\/p>\n<p>       4. The above order of remand is under challenge in<\/p>\n<p>this   revision petition primarily on the ground that         the<\/p>\n<p>prosecution by itself was totally vitiated since   the petitioner<\/p>\n<p>being a public servant, prior sanction under Section 197(1) of<\/p>\n<p>the Code of Criminal Procedure was not admittedly obtained.<\/p>\n<p>Learned    counsel  points out     that  this  contention    was<\/p>\n<p>specifically raised before the learned Sessions Judge. Several<\/p>\n<p>decisions were also cited before the learned Sessions Judge in<\/p>\n<p>support of the above contention.\n<\/p>\n<p>     5. Learned Sessions Judge in paragraph-9 of the impugned<\/p>\n<p>judgment has dealt with the above contention thus:<\/p>\n<blockquote><p>            9. The argument of appellant&#8217;s counsel<br \/>\n       that sanction u\/s 197 Cr.P.C was necessary in<br \/>\n       this case does not appear to be sound. In order<br \/>\n       to attract the requirement of sanction u\/s 197<br \/>\n       Cr.P.C, the accused must be a public servant<br \/>\n       not removable from his office except by or with<br \/>\n       the sanction of the Government and when the<br \/>\n       offence alleged was committed while acting or<br \/>\n       purporting to act in the discharge of this official<br \/>\n       duty. Accused is not proved to be a public<br \/>\n       servant who is not removable from his office<br \/>\n       save by or with the sanction of the Government.\n<\/p><\/blockquote>\n<blockquote><p>       The offence of wrongful        confinement    and<br \/>\n       causing hurt alleged in this case is not an act in<br \/>\n       the discharge of the official duty of the accused.<br \/>\n       Therefore, this argument has no force.&#8221;<\/p><\/blockquote>\n<p>     6. Having heard    learned counsel for the petitioner and<\/p>\n<p><span class=\"hidden_text\">                                 3<\/span><br \/>\nCrl.R.P.No.2641\/04<\/p>\n<p>learned counsel for respondent No.1\/complainant, I am of the<\/p>\n<p>view that there is considerable force in the contention raised<\/p>\n<p>by the petitioner. In my view, learned Sessions Judge ought to<\/p>\n<p>have dealt with the question of sanction appropriately. If the<\/p>\n<p>petitioner ultimately   succeeds    on that issue, he may     be<\/p>\n<p>entitled to get an order of acquittal\/discharge. Since, the<\/p>\n<p>above    question    has not been considered in its       proper<\/p>\n<p>perspective in the light of the precedents, I am satisfied that<\/p>\n<p>the case has to be remitted to the Sessions Court for fresh<\/p>\n<p>disposal in accordance with law.\n<\/p>\n<p>       Therefore, the oder of the learned Sessions Judge is set<\/p>\n<p>aside.  Learned Sessions Judge shall hear the appeal afresh<\/p>\n<p>and dispose it of in accordance with law. It will be open to the<\/p>\n<p>petitioner and respondent No.1 to raise all their contentions<\/p>\n<p>before learned Sessions Judge.
