No.28688 of 2011\n                                   Randhir Singh son of Bhola Singh\n                                                 Versus\n                                         The State Of Bihar\n                                               -----------\n<\/pre>\n<p>2.   21.9.2011               Heard learned counsel for the petitioner and the<\/p>\n<p>                 State.\n<\/p>\n<p>                             The petitioner is apprehending his arrest in a case<\/p>\n<p>                 registered under Sections 341, 323, 354, 37, 506 of the Indian<\/p>\n<p>                 Penal Code and 3(x) of the SC\/ST Act.\n<\/p>\n<p>                             Considering that there is a counter version of the<\/p>\n<p>                 same occurrence and there is a land dispute between the<\/p>\n<p>                 parties, let the petitioner above named be released on<\/p>\n<p>                 anticipatory bail in the event of arrest or surrender before the<\/p>\n<p>                 learned court below within a period of 12 weeks from today in<\/p>\n<p>                 connection with Pupri P.S. case No.35 of 2011 on furnishing<\/p>\n<p>                 bail bonds of Rs.10,000\/- (Ten thousand) with two sureties of<\/p>\n<p>                 the like amount each to the satisfaction of Sub Divisional<\/p>\n<p>                 Judicial Magistrate, Pupri at Sitamarhi, subject to the<\/p>\n<p>                 conditions as laid down under Section 438(2) of the Code of<\/p>\n<p>                 Criminal Procedure as also conditions (i) That one of the<\/p>\n<p>                 bailor will be a close relative of the petitioner who will give an<\/p>\n<p>                 affidavit giving genealogy as to how he is related with the<\/p>\n<p>                 petitioner. The bailor will undertake to furnish information to<\/p>\n<p>                 the Court about any change in address of the petitioner. (ii)<\/p>\n<p>                 That the affidavit shall clearly state that the petitioner is not an<\/p>\n<p>                 accused in any other case and if he is he shall not be<br \/>\n<span class=\"hidden_text\">                                    -2-<\/span><\/p>\n<p>            released on bail, (iii) That the bailor shall also state on<\/p>\n<p>            affidavit that he will inform the court concerned if the petitioner<\/p>\n<p>            is implicated in any other case of similar nature after his<\/p>\n<p>            release in the present case and thereafter the court below will<\/p>\n<p>            be at liberty to initiate the proceeding for cancellation of bail<\/p>\n<p>            on ground of misuse, (iv) That the petitioner will give an<\/p>\n<p>            undertaking that he will receive the police papers on the given<\/p>\n<p>            date and be present on date fixed for charge and if he fails to<\/p>\n<p>            do so on two given dates and delays the trial in any manner,<\/p>\n<p>            his bail will be liable to be cancelled for reasons of misuse, (v)<\/p>\n<p>            That the petitioner will be well represented on each date if he<\/p>\n<p>            fails to do so on two consecutive dates, his bail will be liable to<\/p>\n<p>            be cancelled.\n<\/p>\n<\/p>\n<pre>Narendra\/                        ( Anjana Prakash, J. )\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Randhir Singh vs The State Of Bihar on 21 September, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
