JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 22\/07\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>Rule.\n<\/p>\n<p>\tMr.J.K.Shah, learned Additional Public Prosecutor, waives service of<br \/>\n\tnotice of Rule on behalf of respondent No.1. On the facts and in the<br \/>\n\tcircumstances of the case, and with the consent of the learned<br \/>\n\tadvocates for the respective parties, the application is being heard<br \/>\n\tand finally decided, today.\n<\/p>\n<p>This<br \/>\n\tapplication has been preferred with the following prayers:\n<\/p>\n<p>&#8220;(A)\tAdmit<br \/>\n\tthis Misc. Criminal Application<\/p>\n<p>(B)\tAllow<br \/>\n\tthis Misc. Criminal Application, by directing the Ld. Sessions<br \/>\n\tJudge, Kheda at Nadiad to release the passport of the applicant to<br \/>\n\tenable the applicant to visit London, U.K.  for a period of six<br \/>\n\tmonths by imposing suitable terms and conditions and\/or suitably<br \/>\n\tmodifying the conditions no.(d), (e) and (g) imposed by this Hon&#8217;ble<br \/>\n\tCourt vide order dated 8.5.2009 passed in Misc. Criminal Application<br \/>\n\tNo.5487\/2009, in the interest of justice.\n<\/p>\n<p>(C)\tPending<br \/>\n\tadmission hearing and till final disposal of this Misc. Criminal<br \/>\n\tApplication, interim relief in terms of prayer (B) above may kindly<br \/>\n\tbe granted in the interest of justice.\n<\/p>\n<p>(D)\tYour<br \/>\n\tLordships may be pleased to grant such other and\/or further reliefs<br \/>\n\tas may be deemed fit, just and proper in the interest of justice.&#8221;\n<\/p>\n<p>The<br \/>\n\tapplicant was arrested in connection with offences punishable under<br \/>\n\tSections 498-A, 323, 504 and 114 of the Indian Penal Code read with<br \/>\n\tSections 3 and 7 of the Dowry Prohibition Act, 1961, registered vide<br \/>\n\tC.R.No. II-36\/2009 with Chaklasi Police Station. The applicant<br \/>\n\tpreferred an application being Miscellaneous Criminal Application<br \/>\n\tNo.5487 of 2009 under Section 439 of the Code of Criminal Procedure<br \/>\n\tfor grant of bail. By order dated 08.05.2009, this Court granted<br \/>\n\tbail to the applicant while imposing certain conditions. The<br \/>\n\trelevant conditions are reproduced hereinbelow:-\n<\/p>\n<p>(d)<br \/>\n\tnot leave the local limits of State of Gujarat without the prior<br \/>\n\tpermission of the concerned Sessions Judge.\n<\/p>\n<p>(e)\tmark<br \/>\n\ttheir presence before the Investigating Officer of the concerned<br \/>\n\tpolice station on 15th and 30th day of every<br \/>\n\tmonth of the English calendar year, any time between 10.00 A.M. to<br \/>\n\t5.00 P.M. till the commencement of trial;\n<\/p>\n<p>(g)\tsurrender<br \/>\n\ttheir Passport, if any, to the trial Court within a week;&#8221;\n<\/p>\n<p>Thereafter,<br \/>\n\tthe applicant received a VISA interview call from the British<br \/>\n\tConsulate as he intended to visit London. As the applicant required<br \/>\n\this Passport, he moved Miscellaneous Criminal Application No.13605<br \/>\n\tof 2009 before this Court praying for the release of his Passport<br \/>\n\tfor the purpose of VISA. The said application was allowed by order<br \/>\n\tdated 11.12.2009 of this Court and the applicant was directed to<br \/>\n\treturn his Passport to the Trial Court within 45 days from the date<br \/>\n\ton which it was handed over to him. There was some delay in<br \/>\n\treturning the Passport by the British Consulate, therefore, the<br \/>\n\tapplicant was constrained to move another application being<br \/>\n\tMiscellaneous Criminal Application No.856 of 2010 before this Court,<br \/>\n\tpraying for extension of time to deposit the Passport. The said<br \/>\n\tapplication was allowed by order dated 29.01.2010 and the period for<br \/>\n\tdepositing the Passport was extended upto 27.02.2010.\n<\/p>\n<p>Mr.H.M.Parikh,<br \/>\n\tlearned advocate for the applicant, submits that the applicant has<br \/>\n\tbeen granted a VISA by the British Consulate for two years, i.e. for<br \/>\n\tthe period with effect from 20.01.2010 to 20.01.2012. The applicant<br \/>\n\twas under a bona fide belief that the criminal case that has been<br \/>\n\tregistered against him would be completed within a short span of<br \/>\n\ttime and thereafter he would visit the United Kingdom before expiry<br \/>\n\tof the VISA. However, as now only about six months are left before<br \/>\n\tthe VISA expires, and there does not appear to be a likelihood that<br \/>\n\tthe Trial will be completed before that date as the evidence has not<br \/>\n\tyet started, the applicant is constrained to move the present<br \/>\n\tapplication for modification of the above referred to conditions of<br \/>\n\tbail imposed by order dated 08.05.2009 passed in Miscellaneous<br \/>\n\tCriminal Application No.5487 of 2009. It is further submitted that<br \/>\n\tthe applicant has furnished the address of his brother who resides<br \/>\n\tin the United Kingdom, along with his telephone numbers, to the<br \/>\n\tPolice Inspector, Chaklasi Police Station. The learned advocate for<br \/>\n\tthe applicant states that if the applicant is permitted to visit the<br \/>\n\tUnited Kingdom and the conditions imposed by this Court are relaxed,<br \/>\n\tthe applicant shall return to India from the United Kingdom on, or<br \/>\n\tbefore 31.12.2011, and shall surrender his Passport to the Trial<br \/>\n\tCourt within a period of two weeks from the date of his return. It<br \/>\n\tis further submitted that the applicant shall file an Undertaking to<br \/>\n\tthis effect before the Trial Court, as well.\n<\/p>\n<p>Mr.J.K.Shah,<br \/>\n\tlearned Additional Public Prosecutor, submits that the applicant may<br \/>\n\tbe directed to file the necessary Undertaking and return his<br \/>\n\tPassport within the time stipulated by the Court.\n<\/p>\n<p>Having<br \/>\n\theard the learned advocates for the respective parties and in view<br \/>\n\tof the fact that the VISA of the applicant is likely to expire soon,<br \/>\n\tand as the applicant Undertakes to return to India on, or before,<br \/>\n\t31.12.2011, and surrender his Passport within two weeks of his<br \/>\n\treturn, the following order is passed:-\n<\/p>\n<p>(1)\tThe<br \/>\n\tTrial Court is directed to release the Passport of the applicant<br \/>\n\tafter the applicant files an Undertaking before the said Court, as<br \/>\n\tstated hereinabove.\n<\/p>\n<p>(2)\tConditions<br \/>\n\tNos.(d), (e) and (g) imposed by order dated 08.05.2009 in<br \/>\n\tMiscellaneous Criminal Application No.5487 of 209 shall remain<br \/>\n\ttemporarily suspended from the date of release of the Passport of<br \/>\n\tthe applicant by the Trial Court upto 31.12.2011. Thereafter, the<br \/>\n\tsaid conditions shall automatically be enforced.\n<\/p>\n<p>(3)\tOn<br \/>\n\this return to India on, or before, 31.12.2011, the applicant shall<br \/>\n\tsurrender the Passport to the Trial Court within a period of two<br \/>\n\tweeks from the date of his return.\n<\/p>\n<p>The<br \/>\n\tpetition is partly-allowed in the above terms.
