Davawala, learned advocate for the petitioner.<br \/>\nIt is submitted by her that the members of the petitioner-Union<br \/>\napplied for the posts of Assistant Engineer, pursuant to the<br \/>\nadvertisement dated 01.01.2011. The members of the petitioner-Union<br \/>\nhave the experience and are qualified. They had also applied pursuant<br \/>\nto an earlier advertisement issued in the year 1998. However, no<br \/>\nappointments were made pursuant thereto. The members of the<br \/>\npetitioner-Union, who are eligible and qualified, are now deprived of<br \/>\nthe chance to compete for the post, as they are overage, as per the<br \/>\nstipulation in the advertisement.
