HEMA, J.\n                 ---------------------------------------------------\n                    Bail Appl.No. 5717 of 2008\n                 ---------------------------------------------------\n           Dated this the 14th day of November, 2008.\n\n\n                                     ORDER\n<\/pre>\n<p>            Petition for anticipatory bail.\n<\/p>\n<p>           2. The alleged offences are under Sections 20(b) (ii)<\/p>\n<p>of the NDPS Act and Section 27 (i)(e)(iii) of the Kerala Forest Act.<\/p>\n<p>According to prosecution, A1 to A6 were found in the forest and<\/p>\n<p>A1 was found in possession of 1.490 kgs. of ganja. Except A2<\/p>\n<p>and A4, other accused were arrested from the spot on 14.7.2008<\/p>\n<p>and ganja was also seized. The persons who allegedly ran away<\/p>\n<p>are petitioners (A2 and A4).\n<\/p>\n<p>           3. Learned counsel for                 petitioners submitted that<\/p>\n<p>petitioners are brothers and they are absolutely innocent of the<\/p>\n<p>allegations made. They are falsely implicated at the instance of<\/p>\n<p>first accused with ulterior motive. The 2nd petitioner was not even<\/p>\n<p>present at the place of incident on                   on the alleged date of<\/p>\n<p>occurrence. He was attending a marriage which took place in the<\/p>\n<p>Sub Registrars&#8217; office, Rajakumari on the date and time of<\/p>\n<p>incident. Annexure A1 is a copy of the marriage agreement in<\/p>\n<p>which petitioner has signed as a witness on the same day at Sub<\/p>\n<p>Registrar Office, Rajakumari. The place of occurrence is 200 kms.<\/p>\n<p>away from the Sub Registrar&#8217;s office.\n<\/p>\n<p>            4. Learned counsel for petitioners further submitted<\/p>\n<p>that 2nd accused owed an amount of Rs.23,000\/- to first accused<\/p>\n<p><span class=\"hidden_text\">[B.A.No.5717\/08]                   2<\/span><\/p>\n<p>and he demanded the money back while there was a quarrel and<\/p>\n<p>the first accused gave a complaint to the Mandalam Committee<\/p>\n<p>stating that 2nd accused had assaulted him.        The matter was<\/p>\n<p>settled under the mediation of the President of Congress<\/p>\n<p>Mandalam Committee at Committee          office. An agreement was<\/p>\n<p>also executed on the said date. Rs.3000\/- was given to the first<\/p>\n<p>accused consequent to the settlement on the very same day.<\/p>\n<p>Annexure-2 is the complaint given by first accused against 2nd<\/p>\n<p>accused     before the Committee and       Annexure-3 the copy of<\/p>\n<p>settlement. The balance amount is yet to be given. In the light of<\/p>\n<p>this incident, petitioner deliberately implicated the 2nd accused<\/p>\n<p>and his brother in this offence.\n<\/p>\n<p>            5. This petition is opposed. Learned Public Prosecutor<\/p>\n<p>submitted that the incident was witnessed by various officials and<\/p>\n<p>they had seen the accused running away.           Their names are<\/p>\n<p>mentioned in the mahazar.(Learned counsel for            petitioners<\/p>\n<p>submitted that it is written in the mahazar that the names of 2nd<\/p>\n<p>and 4th accused were given by A3).\n<\/p>\n<p>            6. On hearing both sides, considering the rival<\/p>\n<p>contentions and on perusal of the documents, I am satisfied that<\/p>\n<p>petitioners have     a strong and arguable case, which can be<\/p>\n<p>established only at the time of evidence. If petitioners are not<\/p>\n<p>granted anticipatory bail, it is likely that great injustice will be<\/p>\n<p>caused to them.\n<\/p>\n<p>            Hence, I am     satisfied that anticipatory bail can be<\/p>\n<p>granted to petitioners on conditions. Hence, the following order is<\/p>\n<p>passed:\n<\/p>\n<p><span class=\"hidden_text\">[B.A.No.5717\/08]                   3<\/span><\/p>\n<blockquote><p>      1)    Petitioners shall surrender before the investigating<\/p>\n<p>            officer within 7 days from today and make<\/p>\n<p>            themselves available for interrogation and co-<\/p>\n<p>            operate with the investigation.<\/p>\n<\/blockquote>\n<blockquote><p>      2)    In the event of arrest, they shall be released on<\/p>\n<p>            bail on their executing bond for Rs.25,000\/- each<\/p>\n<p>            with two solvent sureties each for the like sum to<\/p>\n<p>            the satisfaction of the arresting officer on the<\/p>\n<p>            following conditions:\n<\/p><\/blockquote>\n<blockquote><p>             i)   Petitioners   shall    report   before     the<\/p>\n<p>                  investigating officer as and when directed.<\/p>\n<\/blockquote>\n<blockquote><p>             ii)   Petitioners shall not influence or intimidate<\/p>\n<p>                  any witness or commit any offence while<\/p>\n<p>                  on bail.\n<\/p><\/blockquote>\n<blockquote><p>      Petition is allowed.\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<blockquote><p>                                             K.
