We note that the respondents have been served by\n\npublication and vide order dated 9.7.2008 were proceeded\n\nagainst ex-parte.\n\n3.           The appellant was the plaintiff and had instituted a\n\nsuit for recovery of Rs.5,94,820\/- on 17.8.2002.        Since the\n\nappellant is a company registered under the Companies Act,\n\nthe suit was instituted and plaint was signed and verified by\n\none Shri S.S.Rawat, the Branch Manager of the appellant who\nRFA-616-04                                                Page 1 of 3\n claimed authority to do so under the Board Resolution dated\n\n30.5.2002, Ex.PW-1\/1.      The suit was based on commercial\n\ntransactions as per a statement of account in which entries\n\npertaining to the transactions were entered, being Ex.PW-1\/2.\n\n4.           The witness of the plaintiff apart from proving the\n\nBoard Resolution, Ex.PW-1\/1 and the statement of account,\n\nEx.PW-1\/2, proved a legal notice of demand dated 27.4.2002,\n\nEx.PW-1\/3 and postal receipts evidencing dispatch thereof by\n\nregistered post as also UPC, Ex.PW-1\/4, Ex.PW-1\/5 and Ex.PW-\n\n1\/6.   Since the notices were sent by Regd.A.D.Post at two\n\naddresses the acknowledgment cards thereof, evidencing that\n\nthe postal docket was delivered to the notice, were proved as\n\nEx.PW-1\/7 and Ex.PW-1\/8.\n\n5.           In spite thereof, the suit has been dismissed holding\n\nthat the certificate of incorporation of the plaintiff has not\n\nbeen filed. The original minutes book has not been produced\n\nand the original ledger and the bills in respect whereof debit\n\nentries were made have not been produced. So holding, the\n\nsuit has been dismissed.\n\n6.           We may only note that the witness of the appellant\n\nwas not cross-examined by the respondents who were ex-\n\nparte at the trial. Thus, each and every statement made on\n\noath by the witness of the appellant had to be accepted.\n\nFurther, what was the learned Trial Judge doing when he was\n\nexhibiting the documents? Objection to the admissibility and\n\nRFA-616-04                                                Page 2 of 3\n proof of a document has to be raised when a document is\n\nsought to be proved. If so done, the party concerned can take\n\nremedial actions there and then.\n\n7.           Since the witness of the appellant was not cross-\n\nexamined, we hold that the testimony of the witness of the\n\nappellant being not challenged, has to be accepted in toto.\n\n8.           In respect of entries in the statement of account\n\nand the same required to be proved by producing the original\n\ndocuments we may record that only when a party challenges\n\nan entry in a statement of account has the same to be proved.\n\nIf an entry in the statement of account is not challenged, the\n\nparty relying upon the statement of account has not to justify\n\nthe said entry.\n\n9.           We allow the appeal. The impugned judgment and\n\ndecree dated 23.7.2003 is set aside.         Suit filed by the\n\nappellant is decreed in sum of Rs.5,94,820\/-.         We grant\n\nappellant interest on the said sum from the date of the suit till\n\nrealization @9% per annum.\n\n10.
