1.\tBy
\nfiling present petition the petitioner,  under Article 226  of the
\nConstitution of India, the petitioner has prayed to quash and set
\naside the order of detention dated 26.5.2010 passed, against the
\npetitioner, by the respondent No.2   the Commissioner of Police,
\nAhmedabad, in exercise of power under sub-section (2) of Section 3 of
\nthe Gujarat Prevention of Anti Social Activities Act, 1985 (for short
\n PASA Act ). The detenu is  branded as   dangerous person .\n<\/p>\n
2.\tHeard
\nthe learned Advocate for the petitioner and learned AGP Mr. Janak
\nRaval for the respondents. No Affidavit in reply is filed by the
\nrespondents controverting the averments made by the petitioner.\n<\/p>\n
3.\tThe
\ndetenu came to be detained as  dangerous person  on his
\ninvolvement in the offences being  CR No. 3098\/2010 registered with
\nDanilimda Police Station, Ahmedabad.\n<\/p>\n
4.\tIt
\nhas been submitted by the learned Counsel for the petitioner that the
\nallegations made against the detenu are not correct; that the
\nmaterial collected by the detaining authority and looking to the
\nstatement recorded by the detaining authority it cannot be said that
\nthe alleged activities of the petitioner would fall within the
\npurview of  dangerous person <\/p>\n

\nhave gone through the grounds of detention and considered the
\narguments advanced by the learned Counsel for the petitioner as well
\nas the learned A.G.P.\n<\/p>\n
6.\tThe
\nCourt is of the opinion that there is much substance in the arguments
\nadvanced by learned Counsel for the petitioner.  The detaining
\nauthority has placed reliance on the aforesaid registered offences
\nand statements of witnesses. After recording the subjective
\nsatisfaction about the detenu being a dangerous person and with a
\nview to preventing her from acting in a manner prejudicial to the
\nmaintenance of public order, the impugned order of detention was
\npassed by the detaining Authority.\n<\/p>\n
7.\tExcept
\nthe general statement, there is no material on record which shows
\nthat the detenue is acting in such a manner which is dangerous to the
\npublic order. There are number of decisions of this Court as well as
\nthe Hon’ble Apex Court on the point of relying on this point. In view
\nof the ratio laid down by the Hon’ble Supreme Court in the case of\n<\/p>\n
(i) DISTRICT COLLECTOR, ANANTHAPUR v\/s. V. LAXMANAN, reported
\nin (2005) 3 SCC 663; (ii) AMANULLA KHAN KUDEATALLA KHAN
\nPATHAN v\/s. STATE OF GUJARAT, reported in AIR 1999 SC 2197;
\nand (iii) MUSTAKMIYA JABBARMIYA SHAIKH v\/s. M.M. MEHTA,
\nreported in (1995) 3 SCC 237 the Court is of the opinion that
\nthe activities of the detenu cannot be said to be dangerous to the
\nmaintenance of pubic order.  In the case of ASHOKBHAI JIVRAJ @
\nJIVABHAI SOLANKI v\/s. POLICE COMMISSIONER, Surat, reported in 2001
\n(1) GLH 393, having considered the decision of the Hon’ble Apex
\nCourt in the case of Ram manohar Lohia v\/s. State of Bihar,
\nreported in AIR 1966 SC 740, this Court held that the cases
\nwherein the detention order are passed on the basis of the statements
\nof such witness fall under the maintenance of  law and order  and
\nnot  public Order .\n<\/p>\n
8.\tApplying
\nthe ratio of the above decisions, it is clear that before passing an
\norder of detention, the detaining authority must come to a definite
\nfindings that there is threat to the ‘public order’ and it is very
\nclear that the present case would not fall within the category of
\nthreat to a public order. In that view of the matter, when the order
\nof detention has been passed by the detaining authority without
\nhaving adequate grounds for passing the said order, cannot be
\nsustained and, therefore, it deserves to be quashed and set aside.\n<\/p>\n
9.\tIn
\nthe result, this petition is allowed. The impugned order of detention
\ndated 26.5.2010 passed by the respondent No.2   Police
\nCommissioner, Ahmedabad city, is hereby quashed and set aside. The
\ndetenu is ordered to be set at liberty forthwith, if not required in
\nany other case. Rule is made absolute accordingly. Direct service
\npermitted.\n<\/p>\n
