PUBLIC PROSECUTOR for\nRespondent(s) : 1, \nMR PB KHANDHERIA for Respondent(s) : 2, \nNone\nfor Respondent(s) : 3, \n=========================================\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE MD SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 03\/03\/2011 \n\n \n\n \n \n\n\n \n\nORAL\nORDER<\/pre>\n<p>1.\t\tBy<br \/>\nway of this application, applicants have prayed to quash and set<br \/>\naside F.I.R. registered vide I-C.R.No.46 of 2011 before Gandhigram<br \/>\nPolice Station, Rajkot.\n<\/p>\n<p>2.\t\tToday<br \/>\nwhen the matter is called out, complainant is present in the Court.<br \/>\nIt is submitted by the complainant that applicant and complainant are<br \/>\nneighbors and they have settled the dispute and he has no grievance<br \/>\nagainst the applicant. Affidavit to this effect is also placed on<br \/>\nrecord.\n<\/p>\n<p>3.\t\tHeard<br \/>\nlearned Advocates for the respective parties. Dispute is of purely<br \/>\nprivate nature. This Court has gone through investigating papers more<br \/>\nparticularly medical certificate. On perusal of medical certificate,<br \/>\nit appears that injuries are of simple in nature.\n<\/p>\n<p>4.\t\tIn<br \/>\nview of above; settlement arrived between the parties and taking into<br \/>\nconsideration incident which took place and medical certificate, in<br \/>\nopinion of this Court, no useful purpose would be served in<br \/>\ncontinuing with the criminal proceedings and it will be harassment to<br \/>\nthe parties. Hence, a case is made out to exercise powers under<br \/>\nsection 482 of Criminal Procedure Code.\n<\/p>\n<p>5.\t\tIn<br \/>\nthe result, application is allowed.
