Justice R.BASANT\n\n Dated :10\/01\/2008\n\n O R D E R\n                              R.BASANT, J\n                       ------------------------------------\n                          B.A.No.56 of 2008\n                      -------------------------------------\n              Dated this the 10th day of January, 2008\n\n                                   ORDER\n<\/pre>\n<p>      Application for anticipatory bail. Petitioners are the husband<\/p>\n<p>and brother in law of the defacto complainant. There is strain in<\/p>\n<p>the matrimony. The spouses are living separately. The crux of<\/p>\n<p>the allegations is that the husband and brother in law of the<\/p>\n<p>defacto complainant went to the house occupied by the defacto<\/p>\n<p>complainant and allegedly threatened her.\n<\/p>\n<p>      2.    The learned counsel for the petitioners submits that<\/p>\n<p>the allegations are totally unfounded. In fact, the house has been<\/p>\n<p>taken on lease in the name of the 1st petitioner. Because of the<\/p>\n<p>strain in the matrimony, reckless and exaggerated allegations are<\/p>\n<p>being raised against the petitioner, submits the learned counsel<\/p>\n<p>for the petitioners.\n<\/p>\n<p>      3.    The learned counsel for the petitioners prays, the<\/p>\n<p>learned Public Prosecutor does not oppose the said prayer and I<\/p>\n<p>am satisfied in the facts and circumstances of this case that the<\/p>\n<p>petitioners can be granted anticipatory bail. In the absence of<\/p>\n<p>opposition, it is not necessary for me to advert to facts in any<\/p>\n<p>greater detail.\n<\/p>\n<p>      4.    In the result, the Bail Application is, allowed.     The<\/p>\n<p>following directions are issued under Section 438 Cr.P.C.<\/p>\n<p><span class=\"hidden_text\">B.A.No.56 of 2008                    2<\/span><\/p>\n<p>      i)    The petitioners shall appear before the learned Magistrate<\/p>\n<p>at 11 a.m on 17.01.2008. They shall be enlarged on regular bail on<\/p>\n<p>their executing a bond for Rs.25,000\/- (Rupees Twenty Five thousand<\/p>\n<p>only)   each with two solvent sureties each for the like sum to the<\/p>\n<p>satisfaction of the learned Magistrate;\n<\/p>\n<p>      ii)   The petitioners shall make themselves available for<\/p>\n<p>interrogation before the Investigating Officer between 10 a.m and 4<\/p>\n<p>p.m on 18.01.2008 and 19.01.2008 and thereafter between 10 a.m<\/p>\n<p>and 12 noon on all Mondays and Fridays for a period of one months.<\/p>\n<p>Subsequently the petitioners shall make themselves available for<\/p>\n<p>interrogation before the Investigating Officer as and when directed by<\/p>\n<p>the Investigating Officer in writing to do so;<\/p>\n<p>      iii)  If the petitioners do not appear before the learned<\/p>\n<p>Magistrate as directed in clause (i), directions issued above shall<\/p>\n<p>thereafter stand revoked and the police shall be at liberty to arrest the<\/p>\n<p>petitioners and deal with them       in accordance with law as if those<\/p>\n<p>directions were not issued at all;\n<\/p>\n<p>      iv)   If the petitioners were arrested prior to their surrender on<\/p>\n<p>17.01.08 as directed in clause (1) above, they shall be released from<\/p>\n<p>custody on their executing a bond for Rs.25,000\/- (Rupees Twenty Five<\/p>\n<p>thousand only) each without any sureties undertaking to appear before<\/p>\n<p>the learned Magistrate on 17.01.08.\n<\/p>\n<p>                                               (R.BASANT, JUDGE)<br \/>\nrtr\/-\n<\/p>\n<p><span class=\"hidden_text\">B.A.No.56 of 2008    3<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Roji Thomas vs State Of Kerala on 10 January, 2008 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl No. 56 of 2008() 1.
