{"id":240916,"date":"2011-10-20T00:00:00","date_gmt":"2011-10-19T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/veerayatan-rajgir-vs-the-union-of-india-anr-on-20-october-2011"},"modified":"2016-01-01T18:37:26","modified_gmt":"2016-01-01T13:07:26","slug":"veerayatan-rajgir-vs-the-union-of-india-anr-on-20-october-2011","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/veerayatan-rajgir-vs-the-union-of-india-anr-on-20-october-2011","title":{"rendered":"Veerayatan, Rajgir vs The Union Of India &amp; Anr on 20 October, 2011"},"content":{"rendered":"<div class=\"docsource_main\">Patna High Court &#8211; Orders<\/div>\n<div class=\"doc_title\">Veerayatan, Rajgir vs The Union Of India &amp; Anr on 20 October, 2011<\/div>\n<pre>                      IN THE HIGH COURT OF JUDICATURE AT PATNA\n                          Civil Writ Jurisdiction Case No.6842 of 2010\n                                       Veerayatan, Rajgir\n                                              Versus\n                                 The Union of India &amp; Anr.\n                                        ---------------------\n<\/pre>\n<p>03.   20.10.2011                 Mr. Alok Kumar Sinha, learned counsel for the<\/p>\n<p>                   petitioner is present.\n<\/p>\n<p>                                 A prayer has been made on behalf of Mr. Bhupendra<\/p>\n<p>                   Kumar Verma, learned counsel appearing on behalf of the<\/p>\n<p>                   respondent Provident Fund Organization and its authorities for<\/p>\n<p>                   adjournment.\n<\/p>\n<p>                                 The writ petition has been filed questioning the order<\/p>\n<p>                   dated 19.2.2010 passed by the Regional Provident                  Fund<\/p>\n<p>                   Commissioner, Bihar, Patna in purported exercise of power vested<\/p>\n<p>                   under Section 7A of the Employees                Provident Fund and<\/p>\n<p>                   Miscellaneous Provisions Act, 1952 (hereinafter referred to as the<\/p>\n<p>                   &#8216;Act&#8217;) and the Scheme framed thereunder, as contained in<\/p>\n<p>                   Annexure-1,      whereby    the   respondent    Commissioner      while<\/p>\n<p>                   purporting to act in pursuance of the order dated 25.11.2008 placed<\/p>\n<p>                   at Annexure-7, whereby the act was made applicable on the<\/p>\n<p>                   petitioner, has initiated assessment proceedings for determination<\/p>\n<p>                   of the dues for the        anterior period being March, 1972 until<\/p>\n<p>                   1.4.2008, from which date the Act was made applicable on the<\/p>\n<p>                   petitioner.\n<\/p>\n<p>                                 The case of the petitioner in brief is that the respondent<\/p>\n<p>                   authorities under the powers vested under the Act had initiated a<\/p>\n<p>                   similar proceedings as back as in the year 1996 and considering the<br \/>\n<span class=\"hidden_text\">                       2<\/span><\/p>\n<p>response filed on behalf of the petitioner, the proceedings initiated<\/p>\n<p>under Section 7A of the Act was dropped by order dated 22.7.1996<\/p>\n<p>placed at Annexure-3 to the writ petition, inter alia, on grounds of<\/p>\n<p>the petitioner being a charitable institution.     In the circumstances<\/p>\n<p>aforesaid, the Act was held not applicable on the petitioner&#8217;s<\/p>\n<p>establishment.     While the matter rested at that stage a complaint<\/p>\n<p>was filed on behalf of the Veerayatan Employees Union on<\/p>\n<p>30.5.2008 i.e. after a lapse of almost 12 years making a complaint<\/p>\n<p>of deprivation     of their rights flowing       under the Act by the<\/p>\n<p>petitioner establishment.       It is not in dispute that the earlier<\/p>\n<p>proceedings which culminated in the order dated 22.7.1996 was<\/p>\n<p>neither reviewed by the respondent Organization nor any appeal was<\/p>\n<p>filed and thus has become conclusive and binding on the parties.<\/p>\n<p>Following the complaint dated 30.5.2008 a fresh proceeding was<\/p>\n<p>initiated under Section 7A of the Act and the petitioner was directed<\/p>\n<p>to respond to the same by letter dated 27.8.2008 as contained in<\/p>\n<p>Annexure-5.      The petitioner while responding to the notice as<\/p>\n<p>contained in Annexure-5 filed a detailed response mentioning<\/p>\n<p>therein that a similar proceeding under the Act having been initiated<\/p>\n<p>was dropped by order dated 22.7.1996 holding the Act not<\/p>\n<p>applicable on the petitioner and which order continues to remain in<\/p>\n<p>force and has neither been modified nor set aside by a superior<\/p>\n<p>authority under the Act. However, considering the grievance of the<\/p>\n<p>employees the petitioner voluntarily accepted the applicability of the<\/p>\n<p>Act with effect from 1.4.2008. In the circumstances aforesaid, the<\/p>\n<p>Assistant Provident Fund Commissioner vide coverage order dated<br \/>\n<span class=\"hidden_text\">                       3<\/span><\/p>\n<p>25.11.2008     held   the   Act   applicable   on   the   petitioner&#8217;s<\/p>\n<p>establishment with effect from 1.4.2008 and by a stipulation made<\/p>\n<p>in paragraph-9 thereof required the petitioner to make payment of<\/p>\n<p>arrears with effect from 1.4.2008. Learned counsel for the petitioner<\/p>\n<p>submits that the petitioner in compliance of the coverage order as<\/p>\n<p>contained in Annexure-7 has started compliance in terms of the<\/p>\n<p>provisions of the Act and the Scheme framed thereunder and that<\/p>\n<p>the position is not in dispute.    It so appears that following the<\/p>\n<p>coverage order and voluntary acceptance by the petitioner, a second<\/p>\n<p>complaint was made by         the workers Union       on 20.10.2009<\/p>\n<p>requesting the Regional Provident Fund Commissioner to hold that<\/p>\n<p>the workers employed by the petitioner would be entitled to the<\/p>\n<p>benefits arising under the Act with effect from their respective date<\/p>\n<p>of appointment.\n<\/p>\n<p>             It is the complaint of the petitioner that the respondent<\/p>\n<p>Regional Provident Fund Commissioner by the impugned notice<\/p>\n<p>dated 19.2.2010 proceeding mechanically on the complaint filed by<\/p>\n<p>the workers Union has directed remittance of contribution by the<\/p>\n<p>petitioner under the Act and the Scheme framed therein with effect<\/p>\n<p>from March, 1972 until 1.4.2008 being the date from which the<\/p>\n<p>petitioner had voluntarily accepted the applicability of the Act.<\/p>\n<p>Learned counsel for the petitioner makes a very short submission. It<\/p>\n<p>is contended that the earlier proceeding initiated under Section 7A<\/p>\n<p>of the Act having culminated in an order dated 22.7.1996,<\/p>\n<p>whereunder, by a quasi judicial determination of the issue, the<\/p>\n<p>Assistant Provident Fund Commissioner had held the Act not<br \/>\n<span class=\"hidden_text\">                                  4<\/span><\/p>\n<p>         applicable on the petitioner establishment, considering its activities<\/p>\n<p>         being of a charitable character and the said order not having been<\/p>\n<p>         upset by a superior statutory authorities, there lies no occasion for<\/p>\n<p>         the Regional Provident Fund Commissioner to have preponed the<\/p>\n<p>         applicability of the Act from March, 1972 to 1.4.2008 in absence of<\/p>\n<p>         any determination in the coverage order and which is unsustainable,<\/p>\n<p>         in teeth of the order dated 22.7.1996 as well as in violation of the<\/p>\n<p>         statutory provisions.\n<\/p>\n<p>                      Let a comprehensive counter affidavit be filed on behalf<\/p>\n<p>         of the respondent organization in the light of the averments made in<\/p>\n<p>         the writ petition.\n<\/p>\n<p>                      As prayed, put up on 17.11.2011 retaining its position.<\/p>\n<p>                      Until further orders of this Court, the proceedings<\/p>\n<p>         initiated by the Regional Provident Fund Commissioner pursuant to<\/p>\n<p>         the notice dated 19.2.2010 as contained in Annexure-1 shall remain<\/p>\n<p>         stayed.\n<\/p>\n<\/p>\n<p>                                                 (Jyoti Saran, J.)<br \/>\nS.Sb\/-<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211;
