Also perused the counter affidavit of Respondent<\/p>\n<p>                     nos. 2 and 3.\n<\/p>\n<p>                               2. Petitioner is aggrieved by the order dated<\/p>\n<p>                     21.4.2006, Annexure-7 whereunder his PDS licence,<\/p>\n<p>                     bearing No. 70\/85 has been cancelled on the ground that<\/p>\n<p>                     he violated the terms of the licence by distributing lesser<\/p>\n<p>                     quantity of the foodgrain to the consumer attached to his<\/p>\n<p>                     shop. In this connection, petitioner was given notice,<\/p>\n<p>                     bearing Memo No. 1266 dated 28.7.2005, Annexure-1<\/p>\n<p>                     whereunder names of the consumers, who were supplied<\/p>\n<p>                     lesser quantity of foodgrains, were not indicated, but<\/p>\n<p>                     general allegation was made that petitioner is supplying<\/p>\n<p>                     lesser quantity of foodgrains to the consumers attached to<\/p>\n<p>                     his shop. In response to the show cause notice, petitioner<\/p>\n<p>                     filed show cause reply disputing the allegation as also<br \/>\n<span class=\"hidden_text\">                  2<\/span><\/p>\n<p>enclosing the affidavit of various consumers attached to<\/p>\n<p>his shop disputing the allegation levelled against him in<\/p>\n<p>the notice and further stated that on the date of inspection,<\/p>\n<p>registers maintained by him were verified by the<\/p>\n<p>Inspecting Team and no irregularity was found in the<\/p>\n<p>registers. Licensing Authority, however, under order dated<\/p>\n<p>21.4.2006, Annexure-7 to the supplementary affidavit<\/p>\n<p>rejected the cause shown on the ground that during the<\/p>\n<p>inspection Sunder Devi, wife of Bachchan Thakur stated<\/p>\n<p>before the Inspecting Team that she has been provided 12<\/p>\n<p>Kilograms of wheat and 8 Kilograms of rice under<\/p>\n<p>Annapurna Scheme, but on her White-card 18 Kilograms<\/p>\n<p>of wheat and 12 Kilograms of rice has been shown to have<\/p>\n<p>been distributed to her and indication of the higher<\/p>\n<p>quantity of the foodgrains in the White-card tentamounts<\/p>\n<p>to violation of the terms of the licence as also Bihar Trade<\/p>\n<p>Articles (Licenses Unification) Order, 1984. In this<\/p>\n<p>connection, it is further pointed out that Sunder Devi wife<\/p>\n<p>of Bachchan Thakur was never examined by the<\/p>\n<p>Inspecting Team in presence of the petitioner. As she was<\/p>\n<p>not examined in presence of the petitioner, her name was<\/p>\n<p>rightly not indicated in the show cause notice dated<br \/>\n<span class=\"hidden_text\">                  3<\/span><\/p>\n<p>28.7.2005, Annexure-1 as the one supporting the<\/p>\n<p>allegation. It is further submitted that had Sunder Devi<\/p>\n<p>been examined in presence of the petitioner, she would<\/p>\n<p>have been cross-examined by the petitioner with reference<\/p>\n<p>to the entries made in her White-card, as according to the<\/p>\n<p>petitioner whatever quantity of foodgrain was supplied to<\/p>\n<p>her, the same was noted in her White-card and the<\/p>\n<p>allegation to the contrary in the order is wholly incorrect.<\/p>\n<p>          3. From the counter affidavit, it does not appear<\/p>\n<p>that Sunder Devi wife of Bachchan Thakur was ever<\/p>\n<p>examined by the Licensing Authority or the Inspecting<\/p>\n<p>Team in presence of the petitioner so as to grant the<\/p>\n<p>petitioner opportunity to cross-examine her with reference<\/p>\n<p>to the entries made in her White-card.\n<\/p>\n<p>          4. Accordingly, I set aside the impugned order<\/p>\n<p>dated 21.4.2006, Annexure-7 to the supplementary<\/p>\n<p>affidavit directing the Licensing Authority i.e. the Sub-<\/p>\n<p>Divisional Officer, Rajgir to produce Sunder Devi wife of<\/p>\n<p>Bachchan Thakur for being cross-examined by the<\/p>\n<p>petitioner and if petitioner is able to satisfy with reference<\/p>\n<p>to the questions put to her during the cross-examination<\/p>\n<p>that the allegation levelled by her is incorrect then Fair<br \/>\n<span class=\"hidden_text\">                             4<\/span><\/p>\n<p>         Price Shop Licence of the petitioner, bearing No. 70\/85 be<\/p>\n<p>         restored to him.\n<\/p>\n<p>                   5. Necessary order in compliance of the orders<\/p>\n<p>         of the High Court be passed by the Licensing Authority as<\/p>\n<p>         early as possible, in any case within two months from the<\/p>\n<p>         date of receipt\/ production of a copy of this order.<\/p>\n<p>                   6.
