Justice S.SIRI JAGAN\n\n Dated :16\/06\/2009\n\n O R D E R\n                                  S.SIRI JAGAN\n                         ----------------------------------------\n                          W.P.(C).NO.23324 of 2008\n                         -----------------------------------------\n                    Dated this the 16th day of June, 2009\n\n\n                                JUDGMENT\n<\/pre>\n<p>        The Petitioner was elected as the Convener of a Beneficiary<\/p>\n<p>Committee for the construction of Anganavadi No.29 in Pampalil in<\/p>\n<p>Ward No.8 of Panayam Grama Panchayath.                        An agreement    was<\/p>\n<p>executed between the petitioner and the respondents for execution of<\/p>\n<p>the said work, and the Petitioner executed the work satisfactorily.<\/p>\n<p>According to the petitioner for the work done by him a bill for Rs.<\/p>\n<p>3,00,000\/- was raised, out of which only Rs. 1,30,000\/- has been paid,<\/p>\n<p>leaving a balance of Rs. 1,70,000\/-, which still remains unpaid. The<\/p>\n<p>petitioner therefore seeks the following reliefs:<\/p>\n<blockquote><p>               &#8221; i) To call for the Records from the 2nd         respondent<br \/>\n               leading to the work relating           to construction     of<br \/>\n               Anganavadi No.29 in Pampalil in Ward No.8 of Panayam<br \/>\n               Grama Panchayath.\n<\/p><\/blockquote>\n<blockquote><p>                  ii) To issue a writ of mandamus or other appropriate<br \/>\n               writ, order or direction commanding the respondents 1<br \/>\n               and 2 to pay the Bill submitted by the petitioner in<br \/>\n               respect of the work relating           to construction     of<br \/>\n               Anganavadi No.29 in Pampalil in Ward No.8 of Panayam<br \/>\n               Grama Panchayath referred in Ext.P1 and P2 and<br \/>\n               disburse the payment of Rs. 1,70,000\/- with 18% interest<br \/>\n               from 08.03.2007 within a stipulated time as directed by<br \/>\n               this Hon&#8217;ble Court.<\/p><\/blockquote>\n<p>                  iii) To declare that the petitioner is entitled to get the<br \/>\n               payment of Rs. 1,70,000\/- with interest at the rate of 18%<\/p>\n<p>W.P.C.No.23324 of 2008<br \/>\n<span class=\"hidden_text\">                                           2<\/span><\/p>\n<p>                       from 08.03.2007, the date of completion of<br \/>\n                       work referred in Ext.P1 and P2.&#8221;\n<\/p>\n<\/p>\n<p>               2.      A counter affidavit has been filed on behalf of<\/p>\n<p>the 1st respondent, in which it is stated thus:<\/p>\n<blockquote><p>                  &#8221; Even though some delay has been occurred to<br \/>\n                  allot the balance amount of Rs. 1,70,000\/- due to<br \/>\n                  paucity of funds during the year 2008-09, through<br \/>\n                  Supplementary Demand for Grants, Government<br \/>\n                  have allotted Rs. 6,48,15,000\/- for reimbursing the<br \/>\n                  amount    spent    for  the  construction    of  the<br \/>\n                  Anganwadi Centres. Government as per G.O (Rt)<br \/>\n                  NO.428\/2008\/SWD        dated  22.10.2008    (further<br \/>\n                  modified   vide    G.O(Rt)No.489\/2008\/SWD      dated<br \/>\n                  28.11.2008) have accorded sanction for the release<br \/>\n                  of an amount of Rs. 6,48,15,000\/- allotted through<br \/>\n                  SDG, for distribution to the District Social Welfare<br \/>\n                  Officers for effecting pending payment in respect of<br \/>\n                  construction of Anganwadi buildings to all the<br \/>\n                  concerned including the petitioner. True copy of<br \/>\n                  the above Government Order is produced herewith<br \/>\n                  and marked as Ext. R1(a) and R1(b). It is submitted<br \/>\n                  that no further action is pending with this<br \/>\n                  respondent and all further steps are to be taken by<br \/>\n                  the second respondent.&#8221;<\/p><\/blockquote>\n<p>          3.      In view of the above statement in the counter<\/p>\n<p>  affidavit what remains now is only to direct the 2nd<\/p>\n<p>  respondent to take appropriate steps to disburse the<\/p>\n<p>  balance amount of Rs. 1,70,000\/- to the petitioner.<\/p>\n<p>W.P.C.No.23324 of 2008<br \/>\n<span class=\"hidden_text\">                                   3<\/span><\/p>\n<p>          4.      Accordingly the writ petition is disposed of with<\/p>\n<p>  a direction of the 2nd respondent to see that the amount of<\/p>\n<p>  Rs. 1,70,000\/- is paid to the petitioner as expeditiously as<\/p>\n<p>  possible, at any rate, within one month from the date of<\/p>\n<p>  receipt of a copy of this judgment.
