BASANT, J.\n\n           ````````````````````````````````````````````````````\n                   B.A. No. 1191 OF 2008 F\n           ````````````````````````````````````````````````````\n          Dated this the 29th day of February, 2008\n\n                             O R D E R\n<\/pre>\n<p>           Application for anticipatory bail.          Petitioner faces<\/p>\n<p>indictment in a prosecution under section 326 IPC. He is the<\/p>\n<p>2nd accused.     Altogether there are three accused persons.<\/p>\n<p>Final report was filed. Cognizance was taken. The petitioner<\/p>\n<p>was not available for trial. The co-accused faced the trial.<\/p>\n<p>They have been found guilty only under section 324 IPC. The<\/p>\n<p>case against the petitioner has been split up.                 Coercive<\/p>\n<p>processes have been issued against the petitioner.                 The<\/p>\n<p>petitioner apprehends that he may be arrested at any<\/p>\n<p>moment.\n<\/p>\n<p>      2.   The learned counsel for the petitioner submits that<\/p>\n<p>the petitioner is absolutely innocent. His absence earlier was<\/p>\n<p>not wilful or deliberate. The petitioner is willing to surrender<\/p>\n<p>before the learned Magistrate and seek regular bail. But he<\/p>\n<p>BA.1191\/08<br \/>\n<span class=\"hidden_text\">                                : 2 :<\/span><\/p>\n<p>apprehends that his application for bail may not be<\/p>\n<p>considered     by   the  learned     Magistrate  on   merits,  in<\/p>\n<p>accordance with law and expeditiously. He, therefore, prays<\/p>\n<p>that directions under Section 438 or 482 Cr.P.C. may be<\/p>\n<p>issued to the learned Magistrate to release the petitioner on<\/p>\n<p>bail when he appears and applies for bail.<\/p>\n<p>      3.   It is for the petitioner to appear before the learned<\/p>\n<p>Magistrate and explain to the learned Magistrate, the<\/p>\n<p>circumstances under which he could not earlier appear before<\/p>\n<p>the learned Magistrate. I find absolutely no reason to assume<\/p>\n<p>that the learned Magistrate would not consider the application<\/p>\n<p>for bail to be filed by the petitioner on merits, in accordance<\/p>\n<p>with law and expeditiously. Every court must do the same.<\/p>\n<p>No special or specific directions appear to be necessary.<\/p>\n<p>Sufficient general directions have been issued in Alice<\/p>\n<p>George Vs. Deputy Superintendent of Police [2003 (1) KLT<\/p>\n<p>339].\n<\/p>\n<p>      4.   In the result, this petition is dismissed but with the<\/p>\n<p>BA.1191\/08<br \/>\n<span class=\"hidden_text\">                               : 3 :<\/span><\/p>\n<p>specific observation that if the petitioner surrenders before the<\/p>\n<p>learned Magistrate and applies for bail, after giving sufficient<\/p>\n<p>prior notice to the Prosecutor in charge of the case, the<\/p>\n<p>learned Magistrate must proceed to pass appropriate orders<\/p>\n<p>on merits, in accordance with law and expeditiously &#8211; on the<\/p>\n<p>date of surrender itself.\n<\/p>\n<p>     5.    Needless to say, the petitioner can urge before the<\/p>\n<p>learned Magistrate with the help of the judgment in the earlier<\/p>\n<p>case that the allegations, even if accepted, will not amount an<\/p>\n<p>offence under section 326 IPC.
