HAMEEDULLAH (CJ)\nGUPTA, A.C.\nKAILASAM, P.S.\n\nCITATION:\n 1977 AIR 1494\t\t  1977 SCR  (3) 369\n 1977 SCC  (2) 499\n\n\nACT:\n\t    Constitution  of India, Article 136--Powers to be  exer-\n\tcised  when--whether  non-est orders  can  be  ignored--East\n\tPunjab Holdings (Consolidation and Prevention of  Fragmenta-\n\ttion) Act 1948--Section 42 .\n\n\n\nHEADNOTE:\n\t    Gurdev Singh had certain complaints about the Consolida-\n\ttion  Scheme.  He was not present when his  application\t was\n\tbeing\tconsidered.   Therefore,  the application  was\tdis-\n\tmissed by the Additional Director, Consolidation.   Thereaf-\n\tter, Gurdev Singh respondent No. 3 filed an application\t for\n\trestoration  supported by an affidavit attributing  his\t ab-\n\tsence to  his  illness.\t The  Additional  Director  accepted\n\tthe  ground  of respondent No. 3 about illness\tand  granted\n\tnecessary  relief to him.  The appellant filed a  writ.peti-\n\ttion  in  the High Court under Articles 226 and 227  of\t the\n\tConstitution.\tThe High Court held that the  assertion\t  of\n\trights\tby the appellant merely because of some report\tcon-\n\ttained in the \"Fard Badar\" could not take away the effect of\n\tthe entries in the revenue records The High Court also\theld\n\tthat  no injustice was caused to the appellant\tand,  there-\n\tfore,  there  was no ground for interference  under  Article\n\t226.\n\t    In\tan appeal by Special Leave, the appellant  contended\n\tthat  the  Additional Director had no power  to\t review\t his\n\tprevious order.\t The power to review conferred by section 42\n\tof  the\t  Act has to be exercised only\tafter  hearing\t the\n\tinterested parties.  Since respondent No. 3 was not given an\n\topportunity    of being heard on account of his illness,  it\n\tshows  that the order passed was non-est and can be  ignored\n\tat any stage.  The court dismissed the appeal on the  ground\n\tthat this was not a fit case for interference under  Article\n\t136.  the Court, however, observed that if the appellant has\n\tany right on account of long possession or otherwise he\t can\n\tassert\tthem  by adopting proper proceedings  and  that\t his\n\trights\twould  not be affected by whatever is stated  m\t the\n\tJudgment of this Court as well as the High Court.\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t    CIVIL  APPELLATE JURISDICTION: Civil  Appeal  No.\t2150<br \/>\n\tof 1968.\n<\/p>\n<p>\t    (Appeal  by Special Leave from the Judgment\t and   Order<br \/>\n\tdated 5.9.1968 of the Punjab &amp; Haryana High Court in  L.P.A.<br \/>\n\tNo. 458\/68).\n<\/p>\n<p>\tV.C. Puri, for respondent No. 3.<br \/>\n\tThe Judgment of the Court was delivered by<br \/>\n\t    BEG, C.J.  This appeal under Article 136 of the  Consti-<br \/>\n\ttution\tis directed against a very detailed Judgment of\t the<br \/>\n\tPunjab\t&amp; Haryana High Court on a Writ Petition No. 1875  of<br \/>\n\t1965  filed under Articles 226 and 227 of the  Constitution,<br \/>\n\tassailing an order of the Additional Director, Consolidation<br \/>\n\tof  Holdings,  passed on 8 June,  1965. A  perusal  of\tthat<br \/>\n\torder,\ttogether with the earlier order of 4 May, 1965,\t and<br \/>\n\tthe application for restoration dated 15 May, 1965, filed by<br \/>\n\tGurdev\tSingh,\trespondent No. 3, shows: Gurdev\t Singh,\t who<br \/>\n\thad<br \/>\n<span class=\"hidden_text\">\t370<\/span><br \/>\n\tsome  complaint\t against the Consolidation Scheme,  was\t not<br \/>\n\tpresent so that his petition was ordered to be filed by\t the<br \/>\n\tAdditional Director, Consolidation on 4 May, 1965.    Gurdev<br \/>\n\tSingh, soon thereafter i.e. on 15 May, 1965, filed an appli-<br \/>\n\tcation for restoration supported by an affidavit,  attribut-<br \/>\n\ting  his absence on 4 May, 1965, to his illness. The.  order<br \/>\n\tdated 8 June, 1965, of the Additional Director, shows\tthat<br \/>\n\tthe  applicant\tGurdev Singh&#8217;s assertion that he  could\t not<br \/>\n\tattend\tdue  to illness, over which he had no  control,\t was<br \/>\n\taccepted by the Additional Director, who proceeded to  exer-<br \/>\n\tcise his powers under section 42 of the East Punjab Holdings<br \/>\n\t(Consolidation and Prevention\tof Fragmentation) Act,\t1948<br \/>\n\t(hereinafter  referred to as the Act)  and to set right\t the<br \/>\n\tgrievance  of the applicant, Gurdev Singh, after going\tinto<br \/>\n\tall  the relevant records.   The learned Judge of  the\tHigh<br \/>\n\tCourt, who heard the petition also went through the  records<br \/>\n\tvery carefully, came to the conclusion that an assertion  of<br \/>\n\trights by the petitioner\/ appellant, a member of the  Sanjam<br \/>\n\tGroup, merely because  of some report contained in the &#8220;Fard<br \/>\n\tBadar,&#8221;\t could\tnot take away the effect of entries  in\t the<br \/>\n\trevenue\t records.  The learned Judge held that no  injustice<br \/>\n\twas caused to the petitioner\/appellant also,  there  was  no<br \/>\n\tground\tfor interference under Article 226 of the  Constitu-<br \/>\n\ttion.\n<\/p>\n<p>\t    The\t learned counsel for the appellant has\trelied\tupon<br \/>\n\tthe  case of <a href=\"\/doc\/1879199\/\">Harbhajan Singh v. Karam Singh<\/a>&amp; Ors.   reported<br \/>\n\tin   1966   (1) S.C.R. 817, where this Court held  that\t the<br \/>\n\tAddl. Director exercising the powers of the State Government<br \/>\n\thas  no jurisdiction under  section 42 of the Act to  review<br \/>\n\this previous order.\n<\/p>\n<p>\tSection 42 of the Act runs as follows:\n<\/p>\n<blockquote><p>\t\t\t  &#8220;The State Government may at any time\t for<br \/>\n\t\t      the  purpose  of satisfying itself as  to\t the<br \/>\n\t\t      legality\tor  propriety of any  order  passed,<br \/>\n\t\t      scheme  prepared or confirmed  or\t repartition<br \/>\n\t\t      made  by any officer under this Act, call\t for<br \/>\n\t\t      and  examine  the record of any  case  pending<br \/>\n\t\t      before  or disposed of  by  such\tofficer\t and<br \/>\n\t\t      may  pass such order in reference thereto.  as<br \/>\n\t\t      it thinks fit:\n<\/p><\/blockquote>\n<blockquote><p>\t\t\t  Provided that no order or scheme or repar-<br \/>\n\t\t      tition  shall  be varied or  reserved  without<br \/>\n\t\t      giving the parties interested notice to appear<br \/>\n\t\t      and  opportunity to. be heard except  in\tcase<br \/>\n\t\t      where  the State Government is satisfied\tthat<br \/>\n\t\t      the proceedings have been vitiated by unlawful<br \/>\n\t\t      consideration.&#8221;<\/p><\/blockquote>\n<p>\t    The\t proviso  to  Section 42 lays down  that  notice  to<br \/>\n\tinterested parties to appear and opportunity to be heard are<br \/>\n\tconditions precedent   to passing of an order under  Section\n<\/p>\n<p>\t42.    The fact that the Additional Director  was  satisfied<br \/>\n\tthat the respondent, Gurdev Singh, did not have an  opportu-<br \/>\n\tnity  of  being ,heard due to his illness, seems  to  us  to<br \/>\n\tamount to a finding that the proviso. could not be  complied<br \/>\n\twith so that  the previous order could not be held to be  an<br \/>\n\torder  duly passed  under  Section 42 of the Act.  It  could<br \/>\n\tbe  ignored  as\t &#8220;non est.&#8221;  The  view\ttaken  in  Harbhajan<br \/>\n\tSingh&#8217;s case (supra) would not apply to the<br \/>\n<span class=\"hidden_text\">\t371<\/span><br \/>\n\tinstant case although Section 42 of the Act does not contain<br \/>\n\ta  power  of  review.  Orders which are\t &#8216;non  est&#8217;  can  be<br \/>\n\tignored at any stage.\n<\/p>\n<p>\t    On\tthe facts and circumstances of this case,  we  think<br \/>\n\tthat  this is not a fit case for interference under  Article<br \/>\n\t136  of the Constitution. The appellant, if he has  acquired<br \/>\n\tany  rights  by reason of long possession, can\tassert\tthem<br \/>\n\twhenever  any proceedings are taken before a  competent\t au-<br \/>\n\tthority\t to  dispossess\t him.\tWhat we have  held  here  or<br \/>\n\twhatever  has  been held by the High Court will\t not  affect<br \/>\n\tsuch  other  rights, if any, as the Appellant may  have\t ac-<br \/>\n\tquired by reason of possession.\t  We do not know and refrain<br \/>\n\tfrom deciding who is actually in possession and for how long<br \/>\n\tand in what capacity.\tThis appeal is dismissed.
