SANKARAN, J.\n                     ---------------------------\n                      B.A. No. 4677 of 2009\n                ------------------------------------\n             Dated this the 19th day of January, 2010\n\n                            O R D E R\n<\/pre>\n<p>      The petitioner had filed B.A. No.7189\/2008 for the same<\/p>\n<p>relief which is prayed for in this Bail Application. That Bail<\/p>\n<p>Application was dismissed by the learned Single Judge of this<\/p>\n<p>Court as per the order dated 10\/02\/2009. For the sake of<\/p>\n<p>convenience, the order dated 10\/02\/2009 is extracted below:<\/p>\n<blockquote><p>            &#8221; Petition for anticipatory bail.\n<\/p><\/blockquote>\n<blockquote><p>            2. The alleged offence are under Sections 27 of<\/p>\n<p>      Arms Act and 102 of Cr.P.C. According to prosecution,<\/p>\n<p>      a Qualis car and a motorcycle were found parked by<\/p>\n<p>      the side of a road on 11.8.2008 and on search of<\/p>\n<p>      same, sword, chopper etc. were found inside the car.<\/p>\n<p>      On investigation, it is revealed that petitioners have<\/p>\n<p>      kept the weapons      in the car    for the purpose of<\/p>\n<p>      commission of offence.<\/p><\/blockquote>\n<p>            3. Learned counsel for petitioners submitted that<\/p>\n<p>      petitioners are innocent of the allegations made, First<\/p>\n<p>      petitioner had lodged a complaint against one Jaleel<\/p>\n<p>B.A. No. 4677\/2009<br \/>\n<span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>      and the FIR in the said crime is Annexure-I. The said<\/p>\n<p>      Jaleel insisted on to settle the case and since first<\/p>\n<p>      petitioner was not amenable, he was threated with<\/p>\n<p>      dire consequences. Petitioners      have been falsely<\/p>\n<p>      implicated    in this case at the distance of the said<\/p>\n<p>      Jaleel. Petitioners may be grant anticipatory bail, it is<\/p>\n<p>      submitted.\n<\/p>\n<p>             4. Learned counsel for petitioners submitted<\/p>\n<p>      that offence under Section 27 of the Arms Act will not<\/p>\n<p>      be attracted since there is no evidence to show that<\/p>\n<p>      petitioners   have   used  any   prohibited  arms     in<\/p>\n<p>      contravention of Section 7.    The mere possession of<\/p>\n<p>      prohibited arms will not be an offence under Section<\/p>\n<p>      27 of the Arms Act as laid down by the Supreme Court<\/p>\n<p>      in Mahendra Singh v. State of W.B. (AIR 1973 SC<\/p>\n<p>      2288), it is submitted. Therefore, petitioners are not<\/p>\n<p>      liable     for non-bailable offence, it is contended.<\/p>\n<p>      Hence, anticipatory bail      may be granted, it is<\/p>\n<p>      submitted.\n<\/p>\n<p>             5. This petition is opposed. Learned Public<\/p>\n<p>      Prosecutor     submitted that   on investigation, it is<\/p>\n<p>B.A. No. 4677\/2009<br \/>\n<span class=\"hidden_text\">                                  3<\/span><\/p>\n<p>      revealed that all the accused had kept the articles in<\/p>\n<p>      the vehicle and it is not a fit case to grant anticipatory<\/p>\n<p>      bail. It is also pointed out that even if Section 27 of<\/p>\n<p>      Arms Act is not attracted the allegation made in this<\/p>\n<p>      case will clearly fall under Section 25(1A) of the Act.<\/p>\n<p>      If a person is in possession of any prohibited arm in<\/p>\n<p>      contravention of Section 7 of the Act, he will be liable<\/p>\n<p>      under Section 25(1A) of the Act and         it is a non-<\/p>\n<p>      bailable offence. Section 7 prohibits a person from<\/p>\n<p>      possession of any prohibited arm.        Therefore, the<\/p>\n<p>      wrong quoting of section will not be of any help to<\/p>\n<p>      petitioners, it is submitted.\n<\/p>\n<p>             6. On hearing both sides, I am      satisfied that<\/p>\n<p>      investigation is in the initial stage and charge-sheet<\/p>\n<p>      has not been laid. Any misquoting of section will not<\/p>\n<p>      give any benefit to       petitioners.   Considering the<\/p>\n<p>      serious nature of allegations made, this is not a fit<\/p>\n<p>      case to grant anticipatory bail.         The crime was<\/p>\n<p>      registered as early as on 11.8.2008 and petitioners<\/p>\n<p>      are not available for arrest and interrogation. Hence,<\/p>\n<p>      the following order is passed:\n<\/p>\n<p>B.A. No. 4677\/2009<br \/>\n<span class=\"hidden_text\">                                  4<\/span><\/p>\n<p>            1) Petitioner    shall surrender before the<\/p>\n<p>              investigating officer forthwith and co-<\/p>\n<p>              operate with the investigation. Whether he<\/p>\n<p>              surrenders or not, police is at liberty to<\/p>\n<p>              arrest him and proceed in accordance with<\/p>\n<p>              law.\n<\/p>\n<p>            2) No further application for anticipatory bail<\/p>\n<p>              by the petitioner    in this crime will be<\/p>\n<p>              entertained by this Court.\n<\/p>\n<p>        Petition is dismissed.&#8221;\n<\/p>\n<p>      I do no find any ground to entertain a second application<\/p>\n<p>for anticipatory bail. There is no change of circumstance or any<\/p>\n<p>other circumstance warranting the filing of the second application<\/p>\n<p>for anticipatory bail.\n<\/p>\n<p>      For the aforesaid reasons, the Bail Application is dismissed.<\/p>\n<p>                                   K.T.
