MUDGMENE<\/p>\n
    by the appellants is directed against the<\/p>\n
impugned Vujjludgment and award dated 24\/09\/2004 passed in<\/p>\n
 ml. 362\/ 1999 by the Prl. Civil Judge (Sr.Dn) and Addl.<\/p>\n
it –..d\u00a3\\riotor Accidents Claims Tribunal. Tumkur, (hereinafter<\/p>\n
it  V. _ ..i”efe1’red to as ‘ Tribunal’ for short}.<\/p>\n
A<\/p>\n

2. The Tribunal by its judgment and award has
\nawarded a sum of 32,02,200\/– under different heads with
\ninterest at 8% per annum from the date of petition till the<\/p>\n
entire amount is paid, as against the claim of the claitnants<\/p>\n
for a sum of ?’8,00,000\/-, on account of the  {he<\/p>\n
deceased Sri. Venkateshappa, in the road traffic T’  _& if <\/p>\n
3. In brief, the facts of the case are:, <\/p>\n
The appellant No.1 is the ins:  anpellant <\/p>\n
the second wife and appellant”–l\\:los.. 3 and  Mchlildrenll<\/p>\n
of the deceased Sri. Venkatesha;ipaVV'”and they have filed a<\/p>\n
claim petition before the  Lsection 166 of ZVLV.<\/p>\n
Act, clairningf\u00bb \u00a2f”%8,oo,ooo\/–, on account of<\/p>\n
the death of  in the road traffic accident,<\/p>\n
contendin\u00a7’~vthat_._’; on V2″Ol.4.l997 at about 7.15 a.m., the<\/p>\n
  deiceased was travelling as a pillion rider of Scooter bearing<\/p>\n
   which was ridden by one Shashishekara and<\/p>\n
“wiie\ufb01 thevjflnlame near Antharasanahalli, at that time, bus<\/p>\n
 beari.ng\u00ab;No.KA.O6.A.27 came in a rash and negligent manner<\/p>\n
  dashed against the scooter, due to which, deceased<\/p>\n
____\ufb02___”___,,,.,_,._……._<\/p>\n
Eustained injuries a  at the spot. It is the further case<\/p>\n
of the appellants that, the deceased was aged about 45
\nyears, hale and healthy, working as Mason and earning<\/p>\n
more than ?4,000\/– per month and looking after theuwelfare<\/p>\n
of the family and due to his untimely death <\/p>\n
lot. The said claim petition had come up _forV_u_consideratio’n <\/p>\n
before the Tribunal. The TribunalI;after:A4apprec’ia’ting–byoral<\/p>\n
and documentary evidencegand other material’ avetilable\ufb02<\/p>\n
on \ufb01le, has allowed the    and
\nawarded the comp4e’nsaiL_ioHnV. under
\ndifferent headswith from the date of
\npetition    ‘V’  paid. Not being
\nsatisfied of compensation awarded by
\nthe .’tl”ViEd  have presented this appeal,<\/p>\n
for _enh’anceIne\u00bbnt of compensation.<\/p>\n

reslporilde.nt–Insurance Company.<\/p>\n
At ‘T   After careful perusal of the material available on<\/p>\n
record at threadbare, including the impugned judgment<\/p>\n

and award passed by the Tribunal, it emerges that, the
\noccurrence of the accident and the death of the
\ndeceased in the said accident are not in dispute. The<\/p>\n
Tribunal has erred in assessing the income Yo’fr.the<\/p>\n
deceased at $1,800\/– per month for ca1cu1ating”‘tb’e_~p<\/p>\n
dependency and the same is on lower side~rand’i .th’e.1f’efore,’ ii: .. <\/p>\n
needs to be modified. Taking into considerationuthpe age<\/p>\n
and occupation of the deeeasedoand the<\/p>\n
dependents , we re–assess hiVs,:d1ncon21e* – per
\nmonth. Out of whichdif  if v;is”{d.edu_cted towards the<\/p>\n

6. The Tribunal has awarded a sum of —<\/p>\n
