DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 17\/06\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>Mr. J.M.Panchal, learned counsel<br \/>\n\tappearing for the applicant submits that initially name of the<br \/>\n\tapplicant was not mentioned in the complaint.  He further submitted<br \/>\n\tthat the applicant is not connected with the purchase of the old<br \/>\n\tpremises or construction thereof and therefore ingredients of<br \/>\n\talleged offence under section 304 of IPC are not made out against<br \/>\n\thim. He further submitted that the applicant is not partner with the<br \/>\n\tpersons named in the complaint as he is doing the transport<br \/>\n\tbusiness.  Learned counsel further submitted that considering the<br \/>\n\tnature of allegations and role attributed to the applicant, by<br \/>\n\timposing suitable conditions, the applicant may be enlarged on bail.\n<\/p>\n<p>Mr. Raval, learned APP  for the<br \/>\n\trespondent &#8211; State opposed the application on the ground that<br \/>\n\tdue to negligence and carelessness of the promoter and the builder<br \/>\n\tthe house was collapsed and in the unfortunate incident, 5 persons<br \/>\n\tare died and many other persons are injured.\n<\/p>\n<p>Having<br \/>\n\theard learned counsel for the parties and perusing the record of the<br \/>\n\tcase and taking into consideration the facts that except statements<br \/>\n\trecorded by the I.O. to the effect that the applicant herein is<br \/>\n\tpartner with the persons named in the complaint, prima facie there<br \/>\n\tis nothing on record to show that the applicant is partner and<br \/>\n\tinvolvement of the applicant in the alleged crime is subject to the<br \/>\n\tscrutiny of evidence at the stage of trail,  without discussing the<br \/>\n\tevidence in detail, at this stage, I am inclined to enlarge the<br \/>\n\tapplicant on bail  in connection with C.R.No.I-9\/2011 of Kalupur<br \/>\n\tPolice Station  for the offences punishable under sections 304, 338,<br \/>\n\t337, 427 and 34 of the IPC as well as section 267(1)(2) of the<br \/>\n\tBombay Provincial Municipal Corporation Act of the Indian Penal<br \/>\n\tCode, on furnishing   bond of Rs.10,000\/- (Rupees ten thousand only)<br \/>\n\twith one surety of the like amount to the satisfaction of the lower<br \/>\n\tCourt and on conditions that the applicant shall :\n<\/p>\n<p>[a]\tnot take<br \/>\nundue advantage of liberty or abuse liberty;\n<\/p>\n<p>[b]\tnot act in<br \/>\na manner injurious to the interest of the prosecution;\n<\/p>\n<p>[c]\tmaintain<br \/>\nlaw and order;\n<\/p>\n<p>[d]\tmark<br \/>\npresence before the concerned  Police Station on every 1st<br \/>\nand 15th day of English Calender month between  11.00 a.m.<br \/>\nand 2 p.m till commencement of the trial.\n<\/p>\n<p>[e]\tnot leave<br \/>\nthe State of Gujarat without prior permission of the Sessions \tJudge<br \/>\nconcerned;\n<\/p>\n<p>[f]\tfurnish the<br \/>\naddress of residence at the time of execution of the \tbond and shall<br \/>\nnot change the residence without prior permission of  this Court;\n<\/p>\n<p>[g]\tsurrender<br \/>\npassport, if any, to the Lower Court immediately;\n<\/p>\n<p>[h]\tshall not<br \/>\nenter into Ahmedabad city for a period of 3 months;\n<\/p>\n<p>If<br \/>\n\tbreach of any of the above conditions is committed,  the Sessions<br \/>\n\tJudge concerned will be free  to take appropriate action in the<br \/>\n\tmatter.\n<\/p>\n<p>Bail<br \/>\n\tbefore the Lower Court having jurisdiction to try the case.\n<\/p>\n<p>Rule<br \/>\n\tis made absolute.
