Learned APP waives service of Rule.\n<\/p>\n
\tThis
\napplication is filed under Section 439 of the Code of Criminal
\nProcedure in connection with first information report registered at
\nC.R.No.I-167 of 2010 with Kapodra police station, Surat City, for the
\noffences punishable under Sections 302, 364, 365, 201, 114, 118 and
\n120B of the Indian Penal Code.\n<\/p>\n
\tHeard
\nlearned counsel for the parties and perused the record and the charge
\nsheet filed in the case.\n<\/p>\n
\tThe
\nlearned counsel for the applicant submits that the case of the
\nprosecution if taken as it is, it is alleged that three persons were
\nassaulting the deceased and the statement of one Sagar Vajaiya
\nrecorded on 27th June 2010  stated about two persons
\nassaulting the deceased Devraj and they were Ashok alias Chino and
\nVinod Goyani and not the applicant. No overt act is attributed to the
\napplicant herein. The statement of Nagji Vaghasiya who alleged to
\nhave stated that the applicant made confessional statement about
\nassaulting the deceased and the version of the watchman about
\nborrowing stick by the applicant to commit the crime are
\nunbelievable. Investigation is over and charge sheet is filed. He,
\ntherefore, submits that, considering the role attributed to the
\napplicant, this application for bail may kindly be considered.\n<\/p>\n
\tThe
\nlearned Additional Public Prosecutor has opposed grant of bail
\nlooking to the nature and gravity of offence. The learned APP would
\nsubmit that there are two statements which reveal that the deceased
\nDevraj was found in Honda CRV  with swollen hand and the applicant
\nwas instructed to take him to the hospital. The above version,
\ncoupled with recovery of blood from the office of the applicant,
\nwould, according to the learned APP, implicate the applicant with the
\ncrime and, therefore, the applicant may not be enlarged on bail.\n<\/p>\n
\tThe
\nstatement of the watchman reveals about borrowing stick in the
\ncontext of nature of injuries as available and the statement of Ram
\nNagjibhai Vaghasiya on 25.6.2010, reveals about the condition of
\nDevraj with swollen hand and, on the basis of such statements, the
\napplicant cannot be kept behind the bars when the trial is likely to
\ntake considerable long time.\tIn the facts and circumstances of the
\ncase and considering the nature of allegations and  role attributed
\nto the applicant,  without discussing the evidence in detail, prima
\nfacie, this Court is of the opinion that this is a fit case to
\nexercise the discretion to enlarge the applicant on bail.\n<\/p>\n
\tThe
\nparties do not press for further reasoned order.\n<\/p>\n
\tIn
\nthe facts and circumstances of the case, the application is allowed
\nand the applicant is ordered to be released on bail in connection
\nwith first information report registered at C.R.No.I-167 of 2010 with
\nKapodra police station, Surat City, on his executing a bond of
\nRs.5,000\/- (Rupees five thousand only) with one surety of the like
\namount to the satisfaction of the trial court and subject to the
\nconditions that he shall<\/p>\n
 i.\tnot
\ntake undue advantage of his liberty or misuse his liberty;\n<\/p>\n
not act in a manner injuries to
\n\tthe interest of the prosecution;\n<\/p>\n
surrender his passport, if any, to
\n\tthe lower court within a week;\n<\/p>\n
not leave the State of Gujarat
\n\twithout prior permission of the Sessions Judge concerned;\n<\/p>\n
mark his presence at the concerned
\n\tpolice station on the first Sunday of every month between 10 a.m.
\n\tAnd 3 p.m for three months only;\n<\/p>\n
furnish the present  address of
\n\this residence to the I.O. and also to the Court at the time of
\n\texecution of the bond and shall not change the residence without
\n\tprior permission of this Court;\n<\/p>\n
\tThe
\nAuthorities will release the applicant only if he is not required in
\nconnection with any other offence for the time being.\n<\/p>\n
\tIf
\nbreach of any of the above conditions is committed, the Sessions
\nJudge concerned will be free to issue warrant or take appropriate
\naction in the matter.\n<\/p>\n
\tBail
\nbond to be executed before the lower court having jurisdiction to try
\nthe case.\n<\/p>\n
\tAt
\nthe trial, the trial court shall not be influenced by the
\nobservations of preliminary nature, qua the evidence at this stage,
\nmade by this Court while enlarging the applicant on bail.\n<\/p>\n
\tRule
\nis made absolute to the aforesaid extent. D.S. Permitted.\n<\/p>\n
