Thomas for Respondent(s) :\n3. \n======================================\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE R.S.GARG\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 13\/07\/2007 \n\n \n\n \nORAL\nJUDGMENT<\/pre>\n<p>\t\tThe<br \/>\nappellants-claimants, being aggrieved by the award dated 10th<br \/>\nAugust, 1982 passed by the learned Member, Motor Accident Claims<br \/>\nTribunal (Main), Surendranagar in Claim Petition No.318 of 1981, are<br \/>\nbefore this Court with a submission that the learned Tribunal below<br \/>\ndid not award proper amount to the claimants, therefore, the amount<br \/>\ndeserves to be enhanced.\n<\/p>\n<p>2.\t\tShri<br \/>\nMayur Barot, learned Counsel for the appellants, after taking me<br \/>\nthrough the entire evidence and the findings recorded by the learned<br \/>\nTribunal below, submitted that the learned Tribunal was unjustified<br \/>\nin holding that the salary\/income of the deceased was Rs.330\/- per<br \/>\nmonth and further erred in holding that the deceased was only to work<br \/>\nfor a period of five years.  The learned Counsel submitted that from<br \/>\nthe statement of the widow of the deceased, it would clearly appear<br \/>\nthat the deceased was to work for eight years and he was also to get<br \/>\nincrements, etc. It was also submitted that the learned Tribunal<br \/>\nbelow erred in not appreciating that had the deceased completed<br \/>\nfurther service of eight years, he could have earned bonus, gratuity<br \/>\nand provident fund. He submitted that the claimants are entitled to a<br \/>\nfurther sum of Rs.46,000\/-.\n<\/p>\n<p>3.\t\tShri<br \/>\nV. C. Thomas, learned Counsel for respondent No.3, however, submitted<br \/>\nthat the learned Tribunal was absolutely justified in making the<br \/>\naward and the award does not call for any interference.\n<\/p>\n<p>4.\t\tSo<br \/>\nfar as the question of age of the deceased is concerned, it is to be<br \/>\nseen from Exh.46, certificate issued by the Works Manager of<br \/>\nDhrangadhra Chemical Works where the deceased was working, that the<br \/>\ndeceased was getting Rs.630.68 per month and that he had five years&#8217;<br \/>\nservice to  his credit from 23rd November, 1981. The<br \/>\ncertificate has been filed by the appellants; they have consciously<br \/>\nrelied upon the said certificate, therefore, they would not be<br \/>\nallowed to say anything contrary to their own document. From this<br \/>\ndocument, it would be clear that the deceased was earning Rs.630.68<br \/>\nper month and that he only had five years&#8217; service to his credit.<br \/>\nWhere a person is required to serve for a period of five years only,<br \/>\nthen, in his case, application of the multiplier of five cannot be<br \/>\nsaid to be  on lower side. The learned Tribunal was also justified in<br \/>\nholding that the deceased might be investing at least a sum of<br \/>\nRs.230.68 per month on his own self and the dependency of the family<br \/>\nwould be Rs.400\/-. The learned Tribunal below certainly was justified<br \/>\nin finding the dependency to be Rs.4,800\/- per year or Rs.24,000\/-<br \/>\nwith the help of the multiplier.\n<\/p>\n<p>5.\t\tI<br \/>\nfind no reason to interfere with the award.
