In the meantime, the amount so deposited, be directed<br \/>\nto be deposited in fixed deposit in any scheduled bank\/nationalised<br \/>\nbank initially for a period of three years and, in case, if M.A.C.P.<br \/>\nNo.531 of 2007 is not decided, then, again, the same shall be renewed<br \/>\nfor a further period of three years and be kept renewing<br \/>\ntill final disposal of M.A.C.P. No.531 of 2007. The interest accrued<br \/>\nthereon periodically, shall<br \/>\nbe ordered to be withdrawn by the claimants and appellant No.1 shall<br \/>\nbe permitted to receive it on behalf of all the claimants. The fixed<br \/>\ndeposit be made in the name of Nazir of the Court concerned and it<br \/>\nwould be the duty of the Nazir as well as the Court concerned to see<br \/>\nto it that the periodical interest is disbursed to appellant No.1,<br \/>\nwho shall receive the same on behalf of all the claimants<br \/>\nhereinabove. Order accordingly.\n<\/p>\n<p>3.\tMr.Nanavati,<br \/>\nlearned advocate appearing for respondent No.2, at this stage,<br \/>\nsubmitted that the learned counsel for the appellant is also ready<br \/>\nand willing to have the expeditious hearing of M.A.C.P. No.531 of<br \/>\n2007. Mr.Nanavati further submitted that the cognate matters being<br \/>\nM.A.C.P. Nos.632 of 2007 and 633 of 2007 may also be ordered to be<br \/>\nheard along with the same.\n<\/p>\n<p>4.\tIn<br \/>\nview of the above, I am of the view that M.A.C.P. No.531 of 2007 be<br \/>\nheard expeditiously and preferably within a period of six months. So<br \/>\nfar as the hearing of M.A.C.P. Nos.632 of 2007 and 633 of 2007 is<br \/>\nconcerned, the Court may be moved by the parties and the Court may<br \/>\npass appropriate order thereon.\n<\/p>\n<p>5.\tThe<br \/>\nappeal is disposed of with the aforesaid directions.
