Goswami, for the petitioner.\n                            ...\n\n      As per the averments contained in the petition for writ, the\n\npetitioner    was   employed     as      Vidhyarthi   Mitra   with    the\n\nrespondents in the year 2006.            He worked in the capacity\n\naforesaid upto the educational session of 2007-08. Subsequent\n\nthereto, he left the services and acquired qualification of\n\nBachelor of Education (B.Ed).             After obtaining B.Ed, the\n\npetitioner submitted an application to the respondents to re-\n\nemploy him as Vidhyarthi Mitra. No response to the application\n\naforesaid is given this, thus, this petition for writ is preferred.\n\n\n\n      While placing reliance upon the judgment of this Court in\n\nPrahlad Kumar Sharma Vs. State of Rajasthan (S.B. Civil Writ\n\nPetition No.8966\/2009, decided on 22.7.2010), it is submitted by\n\nlearned counsel for the petitioner that the respondents are\n\nrequired to consider the candidature of the petitioner if vacancies\n\nare available with them.\n                                         2\n\n           I do not find any merit in the argument advanced.\n\n\n\n           The directions    in the case of Prahlad Kumar Sharma\n\n     (supra) were given by by this Court relating to the Vidhyarthi\n\n     Mitras who were terminated by the respondents on expiry of the\n\n     terms of contract.     The facts in the instant case are totally\n\n     different.   The petitioner himself left the services to obtain\n\n     qualification of Bachelor of Education, as such, he cannot claim\n\n     for re-employment as a matter of right. In addition to whatever\n\n     stated above, it is also relevant to note that appointment is a\n\n     form of public property and that cannot be distributed as a\n\n     bounty. The public employment is always required to be made\n\n     by adopting a fair and uniform mode.             The petitioner is,\n\n     therefore, required to face a fair process of selection if he desires\n\n     to be recruited as Vidhyarthi Mitra.\n\n\n\n           For the reasons above, I do not find any merit in this\n\n     petition.
