Justice V.RAMKUMAR\n\n Dated :15\/03\/2007\n\n O R D E R\n                             V.RAMKUMAR, J.\n\n                             ----------------------------\n\n                     Bail Application No. 1469\/2007\n\n                             -----------------------------\n\n                   Dated this  15th day of March, 2007\n\n\n                                   O R D E R\n<\/pre>\n<p>              The petitioners, six in number, seek anticipatory bail<\/p>\n<p>on   the   allegation   that   Chalissery   Police   are   at   their   heels   in<\/p>\n<p>connection   with   Crime   No.77\/2007   registered   for   offences<\/p>\n<p>punishable under   Sections 286 and 304-A IPC and   Section 3<\/p>\n<p>of Explosives Substances Act, 1908.<\/p>\n<p>       2.     Pending   these   applications   the   fourth     petitioner,<\/p>\n<p>T.Gopinathan,   who   was   the   third   accused   in   the   case   was<\/p>\n<p>arrested and he subsequently moved an application for regular<\/p>\n<p>bail as B.A.No.1533\/2007 and was enlarged on bail<\/p>\n<p>       3.     The   learned   Public   Prosecutor   on   instructions<\/p>\n<p>submitted that out of surviving petitioners, the first petitioner<\/p>\n<p>is the second accused and the other petitioners are not accused<\/p>\n<p>in   the   case.     In   as   much   as   the   fourth   petitioner   who   is   the<\/p>\n<p>third  accused    had   already   been   granted   bail   by   this   Court,   I<\/p>\n<p>find   no   reason   why   the   first   petitioner   who   is   the   second<\/p>\n<p>accused should not be granted anticipatory bail.<\/p>\n<p>       4.     Accordingly,   a   direction   is   issued   to   the<\/p>\n<p>Investigating   Officer   to   release   the   first   petitioner,   second<\/p>\n<p>accused, on bail for a period of one month   in the event of his<\/p>\n<p>B.A.1469\/2007<\/p>\n<p><span class=\"hidden_text\">                                      2<\/span><\/p>\n<p>arrest   in   connection   with   the   above   case   on   his   executing   a<\/p>\n<p>bond   for   Rs.   10,000\/-   (Rupees   ten   thousand   only)     with   two<\/p>\n<p>solvent sureties each for the like amount to the satisfaction to<\/p>\n<p>the   Investigating   officer   and   subject   to   the   following<\/p>\n<p>conditions:\n<\/p>\n<\/p>\n<blockquote><p>          (a).            The first Petitioner (Second accused)<\/p>\n<p>                 shall   report   before   the   Investigating<\/p>\n<p>                 Officer between 9 a.m. and 11 a.m. on all<\/p>\n<p>                 Wednesdays.<\/p><\/blockquote>\n<pre>\n\n\n\n\n            (b).     The   first   petitioner   (second   accused)\n\n                 shall   make          himself   available   for\n\n                 interrogation   as   and   when     required   by\n\n                 the  Investigating Officer.\n\n\n\n\n           (c).           The first petitioner (second accused)\n\n<\/pre>\n<blockquote><p>                 shall   not   influence   or   intimidate   the<\/p>\n<p>                 prosecution   witnesses   nor   shall   he<\/p>\n<p>                 attempt   to   tamper   with   the   evidence   for<\/p>\n<p>                 the prosecution.\n<\/p><\/blockquote>\n<blockquote>\n<\/blockquote>\n<blockquote><p>           (d).           The first Petitioner (second accused)<\/p>\n<p>                 shall   not   commit   any   offence   while   on<\/p>\n<p>                 bail.\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<p>B.A.1469\/2007<\/p>\n<p><span class=\"hidden_text\">                                        3<\/span><\/p>\n<p>               (e).     The first Petitioner (second accused)<\/p>\n<p>                 shall   surrender   before   the   Magistrate<\/p>\n<p>                 concerned   and   seek   regular   bail   in   the<\/p>\n<p>                 meanwhile.\n<\/p>\n<\/p>\n<p>        5.      If   the   first   petitioner   commits   breach   of   any   of   the<\/p>\n<p>above conditions, the bail granted to him   shall be liable to be<\/p>\n<p>cancelled.\n<\/p>\n<\/p>\n<p>        6.      In the result, the  application is disposed of granting<\/p>\n<p>anticipatory bail to the first petitioner, second accused.
