Shah appears and waives service of notice of rule on<br \/>\nbehalf of respondent Nos.1 to 5 &#8211; original claimants. The<br \/>\npresence of other party to the proceedings would not be required at<br \/>\nthis stage.\n<\/p>\n<p>2.\tThe<br \/>\npresent application is for interim injunction pending the First<br \/>\nAppeal against the execution of the judgment and award passed by the<br \/>\nTribunal which is impugned in the First Appeal.\n<\/p>\n<p>3.\tConsidering<br \/>\nthe facts and circumstances of the case and in view of the grounds<br \/>\nstated in the application for stay, there shall be interim injunction<br \/>\nagainst execution and implementation of the judgment and award passed<br \/>\nby the Tribunal on condition that the applicant deposits the entire<br \/>\naward amount together with the costs and interest with the Tribunal<br \/>\nwithin a period of six weeks from today.\n<\/p>\n<p>4.\tWe<br \/>\nhave heard learned counsel for the applicant-appellant as well<br \/>\nas learned counsel for the original claimants on the aspect of<br \/>\nwithdrawal.\n<\/p>\n<p>5.\tConsidering<br \/>\nthe facts and circumstances, out of the amount which may be<br \/>\ndeposited, the original claimants shall be permitted to withdraw 20%<br \/>\nof the amount as per the inter-se proportion decided by the Tribunal<br \/>\nand the remaining 80% of the amount shall be invested by the Tribunal<br \/>\nwith the nationalized bank in the Fixed Deposit Receipts initially<br \/>\nfor a period of three years and such investment shall be renewed from<br \/>\ntime to time until the First Appeal is finally disposed of. The<br \/>\noriginal claimants shall be entitled to the periodical interest as<br \/>\nand when it becomes due. The original Fixed Deposit Receipts<br \/>\nshall be retained by the Nazir of the Tribunal. It is also directed<br \/>\nthat the disbursement and the apportionment shall be made as per the<br \/>\ninter-se apportionment made by the Tribunal in the award amongst the<br \/>\nclaimants.\n<\/p>\n<p>6.\tThe<br \/>\napplication is disposed of accordingly.
