SINHA &amp; HARJIT SINGH BEDI\n\nJUDGMENT:\n<\/pre>\n<p>J U D G M E N T<\/p>\n<p>CRIMINAL APPEAL NO 1219 \/2007<br \/>\n(arising out of S.L.P.(Crl) No. 5172\/2006)<\/p>\n<p>HARJIT SINGH BEDI,J.\n<\/p>\n<p>1.\t\tLeave granted.\n<\/p>\n<p>2.\t\tThis is a case of filicide  the victim Rajesh aged<br \/>\neight years was the son of the accused\/appellant.\n<\/p>\n<p>3.\t\t This appeal arises out of the following facts.\n<\/p>\n<p>4.            The appellant Sanwariya Lal was married to Shanti<br \/>\nBai several years earlier and a son Rajesh was born out of the<br \/>\nmarriage.  On account of a discord between the couple, Shanti<br \/>\nBai returned to her parental home and the appellant started to<br \/>\nlive with Anguri PW.7 whereafter Shanti Bai was given in<br \/>\n&#8216;Nata&#8217; to some other person though Rajesh remained with his<br \/>\nmaternal grand parents.  It also appears that a settlement had<br \/>\nbeen arrived at between the appellant and his wife and their<br \/>\nrespective second spouses and a sum of Rs.20, 000\/- was<br \/>\ndeposited in a fixed deposit in Rajesh&#8217;s name though he<br \/>\ncontinued to stay with his maternal grand parents  and was<br \/>\nadmitted to a school in Jalian. The appellant and Anguri came<br \/>\nto the school to take the child with them but he showed his<br \/>\nreluctance.  The teacher too refused permission to take the<br \/>\nchild during school hours and called his maternal grand<br \/>\nmother who permitted Rajesh to go with his father. On<br \/>\n25th December 2000 at about 5 or 6 p.m. information was<br \/>\nreceived by Prahlad PW.5, Rajesh&#8217;s maternal uncle that he had<br \/>\nbeen taken to hospital with injuries and had thereafter<br \/>\nsuccumbed to them.  A First Information Report was lodged by<br \/>\nPrahlad at Police Station Nimbaheda alleging that Rajesh had<br \/>\nbeen murdered.  Inquest proceedings under section 174 of the<br \/>\nCr.P.C. were conducted and the dead body was dispatched for<br \/>\nthe post-mortem examination. The Post-mortem conducted by<br \/>\nDr. Ganpat Lal Jain confirmed the presence of several injuries<br \/>\non the dead body  one, a fracture of the right pelvis and<br \/>\ncontusion marks in the muscles and the second a contusion<br \/>\non the head and neck and multiple abrasions on the right<br \/>\nhand and frontal side of the arms.  He also stated that the<br \/>\ninjury on the pelvis could not have been caused by a simple<br \/>\nfall though the injury was possible if the fall had been on a<br \/>\nhard surface.   The trial Court in its judgment observed that<br \/>\nthe case was based on circumstantial   evidence and for this<br \/>\npurpose placed reliance on the statement of PW4, the first<br \/>\ninformant,  PW2 Bagdi Ram and PW5 Jasraj who deposed with<br \/>\nregard to the dispute between Shanti and the appellant and<br \/>\ncircumstances which had led to the compromise between<br \/>\nthem, their respective second marriages and that the appellant<br \/>\nhad suspected Rajesh&#8217;s paternity and believed  that he had<br \/>\nbeen conceived on account of an illicit relationship of his<br \/>\nmother with some other person.  It was further observed that<br \/>\nthe appellant had his eye on the sum of Rs.20, 000\/- that had<br \/>\nbeen deposited in a fixed deposit in the name of the deceased.<br \/>\nTwo important witnesses PW7 Anguri the second wife of the<br \/>\nappellant and PW 10 Satya Nariyan a close relative and also a<br \/>\nresident of village Arniya Mali to which the appellant belonged<br \/>\nwere however declared hostile.   By way of corroboration, the<br \/>\nprosecution also relied on the statement of R.B.Mishra PW18<br \/>\nwho was the senior Branch Manager in the Bank of Baroda,<br \/>\nNimbahaida and who deposed that on 28.8.2000 the appellant<br \/>\nhad deposited a sum of Rs.20, 000\/- in the name of the Raju.<br \/>\nThe prosecution also sought support from the statement of<br \/>\nPW21 Lila Malviya the teacher in the Government Primary<br \/>\nSchool who stated that on 2.12.2000 the appellant and his<br \/>\nsecond wife had come to take Rajesh from School but had<br \/>\nbeen advised to wait till 4.30 pm, and finally the opinion of the<br \/>\nMedical Board that the injuries could not have been caused by<br \/>\na fall from a by-cycle.\n<\/p>\n<p>5.\t\tThe accused in his statement denied all the<br \/>\nallegations against him and further stated that Rajesh had<br \/>\nsuffered serious injuries after falling from a by-cycle and also<br \/>\nproduced DW-2 Bheru Lal, the maternal grand-father of the<br \/>\ndeceased in support of this plea.\n<\/p>\n<p>\t6.\tThe trial court relying on the evidence of the<br \/>\naforesaid witness observed that as the appellant was none<br \/>\nother that the father of the deceased, and that the incident<br \/>\nhad happened in the family home and no cogent explanation<br \/>\nfor the death had been offered by the appellant, convicted the<br \/>\nappellant for an offence punishable under Section 302 of the<br \/>\nIPC and sentenced him  to undergo rigorous imprisonment for<br \/>\nlife and to a fine of Rs.1000\/- and in default thereof to<br \/>\nundergo an additional sentence of 6 months.  It is in this<br \/>\ncircumstance that the appeal is before us.\n<\/p>\n<p>7.\tThe learned counsel for the appellant has argued that<br \/>\nPW7 Anguri Bata and PW10 Satyanarain the two primary<br \/>\nwitnesses who could have revealed as to what had actually<br \/>\nhappened had been declared hostile at the trial and as such<br \/>\nthe case rested on circumstantial evidence alone and the chain<br \/>\nof circumstances sufficient to justify an order of conviction<br \/>\nwere not complete.  She has pointed out that from the medical<br \/>\nevidence the cause of death could not be categorically<br \/>\nascertained and that the nature of injuries on the dead body<br \/>\nbeing contusions and abrasions largely suggested that the<br \/>\ndeath was on account of a fall from a by-cycle and this has<br \/>\nbeen confirmed by DW-2 who was none other than the<br \/>\nmaternal grand-father of the deceased.\n<\/p>\n<p>8.\t\tThe State counsel has on the contrary emphasized<br \/>\nthat the chain of circumstances envisaged in a case of<br \/>\ncircumstantial evidence was complete, and the judgment of<br \/>\nconviction was justified.\n<\/p>\n<p>9.\t\tWe have gone through the evidence very carefully.<br \/>\nIt is true that the only two persons who could have perhaps<br \/>\nput light on the incident that is PW7 and PW10 have not<br \/>\nsupported the prosecution. We, however, find that the chain of<br \/>\ncircumstances against the appellant is nonetheless clearly<br \/>\nmade out.   The fact of marriage with Shanti, a dispute<br \/>\nbetween the couple which had resulted in a separation and a<br \/>\nsecond marriage for both under custom has been virtually<br \/>\nadmitted.   It also stands admitted that a sum of Rs.20,000\/-<br \/>\nhad been deposited in a fixed deposit for 20 months by the<br \/>\nappellant in Rajesh&#8217;s name in the Bank of Baroda.  The<br \/>\nprosecution evidence further reveals that the appellant had<br \/>\nsuspected Rajesh&#8217;s paternity and believed that he was  not the<br \/>\nfather and that he also had an eye on the fixed deposit which<br \/>\nhad been put in the name of the deceased.  It is thus clear<br \/>\nthat the motive for the incident stands proved.\n<\/p>\n<p>10.\t\tWe also find from the prosecution evidence,<br \/>\nincluding the statement of the school teacher that the<br \/>\nappellant had taken the deceased away from school and we<br \/>\ntend to believe that this exercise had been planned as the<br \/>\nappellant intended to do away with him.\n<\/p>\n<p>11.\t\tWe have also gone through the medical evidence<br \/>\nwith particular reference to the statement of the Doctor who<br \/>\nhad conducted the post-mortem examination.  The injuries are<br \/>\nreproduced below:\n<\/p>\n<p>\t1. There is contusion of muscles and fracture of<br \/>\nsupramus of Rt. side of pelvis. Ante mortal in nature.\n<\/p>\n<p>\t2. There is dissection of abdominal muscles from Rt.<br \/>\nRenal to public area present. Muscles contused. Ante mortal<br \/>\nin nature.\n<\/p>\n<p>\t3. Contusion 3 x 5 cm over Rt. Parietal region. Ante<br \/>\nmortem in nature.\n<\/p>\n<p>\t4. Contusion 6 x 5 cm over Parietal region. Ante<br \/>\nmortem in nature.\n<\/p>\n<p>\t5. Contusion 3 x 1 cm and 2 x 1 cm over Lt. Ear<br \/>\nregion.  Ante mortem in nature.\n<\/p>\n<p>\t6. Abrasion 1.5 x 3 cm over on chin Rt. Side. Ante<br \/>\nmortem in nature.\n<\/p>\n<p>\t7. Abrasion 1.5 x 1 cm on frontal side of neck. Ante<br \/>\nmortem in nature.\n<\/p>\n<p>\t8. Multiple abrasions of various sizes over Lt. side of<br \/>\nchest. Ante mortem in nature.\n<\/p>\n<p>\t9. Multiple abrasions of various sizes on Rt. Arm,<br \/>\nRt. forearm. Ante mortem in nature.\n<\/p>\n<p>\t10. Abrasion 3 x 1 cm size over Lt. Shoulder joint.<br \/>\nAnte mortem in nature.\n<\/p>\n<p>\t11. Abrasion 2 x 2 cm on Rt. Knee, Rt. Thigh region.<br \/>\nAnte mortem in nature.\n<\/p>\n<p>\t12. Contusion 3 x 1 cm Lt. Knee and Lt. side of 4\/3<br \/>\nof thigh.  Ante mortem in nature.\n<\/p>\n<p>\t13. Abrasion 3 x 1 cm size above umblius.  Ante<br \/>\nmortem in nature.\n<\/p>\n<p>12.\t\tWe are of the opinion that such extensive injuries<br \/>\nincluding a fracture could not have caused by a simple fall as<br \/>\nhas been suggested and clearly show the use of excessive<br \/>\nforce.  It is pertinent to note that the appellant has not been<br \/>\nable to explain the presence of such a large number of injuries<br \/>\nas he was called upon to do as they had undoubtedly been<br \/>\nsuffered at home.  The attempt by the defence to prop up<br \/>\nRajesh&#8217;s grand father as a defence witness to support the story<br \/>\nof a fall from a by-cycle cannot be believed as he was not an<br \/>\neye witness to the fall.\n<\/p>\n<p>13.\t\tWe are therefore of the opinion that the<br \/>\ncircumstances clearly implicate the appellant in the murder.<br \/>\nWe accordingly dismiss the appeal.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Sanwariya Lal vs State Of Rajasthan on 14 September, 2007 Author: H S Bedi Bench: S.B.
