Amod, District : Bharuch were acquired for<br \/>\nthe purpose of construction of Narmada Canal Project.  The<br \/>\nnotifications u\/s 4 and 6 were published and thereafter, the Special<br \/>\nLand Acquisition Officer declared his award on 29.09.1997 whereby he<br \/>\nawarded Rs. 460\/- per Are as against the claim of the claimants.\n<\/p>\n<p>2.1\tBeing<br \/>\naggrieved by the said award of the Special Land Acquisition Officer,<br \/>\nthe original applicant filed reference under section 18 of the Land<br \/>\nAcquisition Act before the Reference Court.  The reference court<br \/>\npassed the aforesaid award.  Hence the present appeals.\n<\/p>\n<p>3.\tMs.\n<\/p>\n<p>Krina Calla, learned AGP appearing for the State has submitted that<br \/>\nthe reference court ought to have seen that the claimant has failed<br \/>\nto prove that the compensation awarded by the special land<br \/>\nacquisition officer is inadequate and not proper.   She has further<br \/>\nsubmitted that the reference court has determined the market value of<br \/>\nthe land in question for the whole area which is acquired.  She has<br \/>\nsubmitted that the reference court ought to have seen that the whole<br \/>\narea is not being cultivated and the market value ought to have been<br \/>\ntaken into consideration of the area which was being cultivated.\n<\/p>\n<p>4.\tThis<br \/>\ncourt has gone through the documentary evidence placed on record<br \/>\nalongwith the award of the reference court.  The reference court has<br \/>\nrelied upon various exhibits produced by the parties and after<br \/>\nconsidering the evidence in detail passed the aforesaid award.  This<br \/>\nCourt is in complete agreement with the reasonings and method adopted<br \/>\nand findings arrived at by the reference court.\n<\/p>\n<p>5.\tMoreover,<br \/>\nthis appeal is also covered by a decision of this Court wherein the<br \/>\nawards passed in reference cases of the adjoining village and same<br \/>\nTaluka have been challenged.  This Court has upheld the method<br \/>\nadopted by the reference court in the land reference case nos. 2549<br \/>\nto 2557 of 1997 and dismissed the said group of appeals being appeals<br \/>\nno. 4098 to 4104 of 2007 vide order dated 02.09.2008.  In that view<br \/>\nof the matter also, since the present group of appeals are covered by<br \/>\nthe said decision rendered in First Appeals no. 4098 to 4104 of 2007,<br \/>\nthis group of appeals are required to be dismissed.\n<\/p>\n<p>6.\tIn<br \/>\nthe premises aforesaid, first appeals are dismissed.
