CHAUHAN S\/O LATE BACHUBHAI CHAUHAN - Petitioner(s)\n \n\nVersus\n \n\nSTATE\nOF GUJARAT &amp; 2 - Respondent(s)\n \n\n=========================================================\n \nAppearance : \nMR\nPINAKIN M RAVAL for\nPetitioner(s) : 1, \nGOVERNMENT PLEADER for Respondent(s) : 1 -\n2. \nRULE SERVED for Respondent(s) : 1 -\n3. \n=========================================================\n\n\n \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE KS JHAVERI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 20\/04\/2010 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>1.\tBy<br \/>\nway of this petition under Article 226 of the Constitution of India,<br \/>\nthe petitioner has prayed to direct the respondent-authorities to<br \/>\nconsider her case for the grant of compassionate appointment.\n<\/p>\n<p>2.\tThe<br \/>\nfather of the petitioner was serving as a Class-IV employee at<br \/>\nGeneral Hospital, Amreli and died in harness on 30.09.1996. On<br \/>\n27.12.1996 the mother of the petitioner made an application to the<br \/>\nrespondent-authority for grant of compassionate appointment.<br \/>\nThereafter, on 10.06.1997, the petitioner made a representation to<br \/>\nrespondent no.3 for granting him compassionate appointment. However,<br \/>\nthe said application came to be rejected vide order dated 06.02.2001<br \/>\non the ground that the income of the family of the deceased exceeded<br \/>\nthe ceiling limit.\n<\/p>\n<p>3.\tOn<br \/>\n10.03.2000 the State Government issued another Circular, in pursuance<br \/>\nof which the petitioner made another application to the respondents,<br \/>\nwhich was forwarded to the Gujarat Gaun Seva Pasandgi Mandal by<br \/>\nrespondent no.3. However, vide order dated 13.03.2006, the<br \/>\napplication of the petitioner was rejected by the said Mandal. Being<br \/>\naggrieved by the same, the petitioner has preferred the present<br \/>\npetition.\n<\/p>\n<p>4.\tHeard<br \/>\nlearned counsel for the respective parties and perused the documents<br \/>\non record. The application of the petitioner for the grant of<br \/>\ncompassionate appointment was rejected on the ground that the<br \/>\npetitioner was residing separately at the time when his father had<br \/>\nexpired and that his mother was serving as a Class-IV employee in the<br \/>\nHospital. Thus, on the grounds that the income was exceeding the<br \/>\nceiling limit and that the petitioner was residing separately at the<br \/>\ntime when the deceased-employee had expired, the case of the<br \/>\npetitioner was not considered. The said decision has been taken on<br \/>\nthe basis of the policy which was prevailing at the relevant point of<br \/>\ntime. Looking to the facts of the case, I do not find that the<br \/>\nrespondent-authority has committed any illegality by rejecting the<br \/>\ncase of the petitioner.\n<\/p>\n<p>5.\tFor<br \/>\nthe foregoing reasons, the petition is dismissed.
