Justice P.S.GOPINATHAN\n\n Dated :12\/07\/2010\n\n O R D E R\n    C.N.Ramachandran Nair &amp; P.S.Gopinathan, JJ.\n   ============================================\n              W.P.(C)No.20060 of 2010\n   ============================================\n       Dated this the 12th day of July, 2010.\n\n\n                     JUDGMENT\n<\/pre>\n<p>Ramachandran Nair, J.\n<\/p>\n<p>\n Writ petition is filed for a direction to the<\/p>\n<p> respondents not to proceed with the construction<\/p>\n<p> of Thakaraparambu fly over in Thiruvananthapuram<\/p>\n<p> under the Capital Region Development Programme.<\/p>\n<p> At admission stage, we heard the petitioner in<\/p>\n<p> person, Government Pleader for respondents 1 and<\/p>\n<p> 2 and standing counsel for the third respondent.<\/p>\n<p> Petitioner&#8217;s  case  is   that  the   fly  over is<\/p>\n<p> absolutely unnecessary and it is a complete waste<\/p>\n<p> of money because, the area where it is proposed<\/p>\n<p> to be constructed is not a priority area and it<\/p>\n<p> will not achieve the purpose of de-congestion of<\/p>\n<p> traffic in the city.    Petitioner claims to have<\/p>\n<p> persuaded the Railways to drop the proposal of<\/p>\n<p><span class=\"hidden_text\">WPC20060\/10              -:2:-<\/span><\/p>\n<p>investment of over Rs.10 crores for controlling<\/p>\n<p>flood in the railway lines.        While Government<\/p>\n<p>Pleader    seeks time  for    getting  instructions,<\/p>\n<p>counsel for the third respondent submitted that<\/p>\n<p>this petition may be disposed of directing the<\/p>\n<p>petitioner to raise his objections before the<\/p>\n<p>High Level Committee chaired by the Principal<\/p>\n<p>Secretary, Public Works Department.    According to<\/p>\n<p>the counsel, Secretary of the third respondent is<\/p>\n<p>the Secretary of the High Level Committee.       In<\/p>\n<p>these circumstances, we feel petitioner should be<\/p>\n<p>given     first  opportunity    to   represent  his<\/p>\n<p>objections before the High Level Committee, so<\/p>\n<p>that the Committee can give priority to any other<\/p>\n<p>work,     if  the   present    proposal   is   found<\/p>\n<p>unnecessary.    Writ petition is hence disposed of<\/p>\n<p>with   direction  to  the    Secretary, High   Level<\/p>\n<p>Committee     to    put   up     the   petitioner&#8217;s<\/p>\n<p>representation   in   the   committee  meeting  and<\/p>\n<p><span class=\"hidden_text\"> WPC20060\/10             -:3:-<\/span><\/p>\n<p> arrange for a hearing during the meeting so that<\/p>\n<p> the petitioner gets an opportunity to represent<\/p>\n<p> his objections along with other objectors, if<\/p>\n<p> any, who could also be heard together before<\/p>\n<p> finalizing the project, if not already done.<\/p>\n<p> Petitioner will file a representation along with<\/p>\n<p> a  copy    of this  judgment,  sketches  or  other<\/p>\n<p> details before the Secretary, Thiruvananthapuram<\/p>\n<p> Development Authority for him to take up the<\/p>\n<p> matter with the Committee.
