The<br \/>\nsaid petition was directed against the judgment and award of the<br \/>\nIndustrial Tribunal passed in Reference (IT) No.17\/1999 on 14.5.2003.<br \/>\nThe said Reference was made pursuant to departmental action against<br \/>\nthe appellant. The appellant was found to be involved in the<br \/>\nmisconduct of not issuing tickets to passengers even after collecting<br \/>\nmoney for the same. The disciplinary authority passed an order of<br \/>\ndismissal. The said order was challenged in first departmental<br \/>\nappeal, which came to be<br \/>\ndismissed. The appellant preferred second departmental appeal, where<br \/>\nthe appellate authority reduced the punishment from dismissal to<br \/>\nreduction to minimum pay scale. Aggrieved thereby, the appellant<br \/>\nmoved the Tribunal and the Tribunal rejected the Reference.<br \/>\nUltimately, the petition was filed, which also came to be dismissed.<br \/>\nHence, this appeal.\n<\/p>\n<p>2.\tHeard<br \/>\nlearned advocate Mr.Rathod for the appellant and learned advocate<br \/>\nMr.Munshaw for the respondent.\n<\/p>\n<p>3.\tWe<br \/>\nhave been taken through the orders and we find that so far as<br \/>\ninvolvement of the appellant in the misconduct is concerned, it is<br \/>\nindisputable. So far as the departmental proceedings are concerned,<br \/>\ntheir legality and validity is not under challenge. So far as the<br \/>\nquantum of punishment is concerned, there is consistent finding by<br \/>\nthe Tribunal and the learned Single Judge. The second appellate<br \/>\nauthority has exercised its jurisdiction and has already awarded a<br \/>\nlenient punishment. Nothing is shown to us that the punishment<br \/>\nawarded is disproportionate to the misconduct or that there is an<br \/>\nelement of arbitrariness. All aspects are considered by both the<br \/>\nlearned Single Judge as well as the learned Tribunal. We do not find<br \/>\nany legitimate reason for interfering with the findings.
