BASANT, J.\n\n                          - - - - - - - - - - - - - - - - - - - - - -\n\n                          Crl.M.C.No.  2146 of   2007\n\n                          - - - - - - - - - - - - - - - - - - - - - -\n\n                    Dated this the   4th   day of   July, 2007\n\n\n                                       O R D E R\n<\/pre>\n<p>        The     petitioner     faces   indictment   in   a   prosecutions   under<\/p>\n<p>Section   138   of   the   N.I.   Act.             Cognizance   has   been   taken.     The<\/p>\n<p>petitioner could not appear before the learned Magistrate on the date<\/p>\n<p>of   posting     as   the   date   was   noted   wrongly.     Consequently   non-<\/p>\n<p>bailable warrant has been issued against the petitioner  reckoning him<\/p>\n<p>as   an   absconding   accused.         According   to   the   petitioner   she   is<\/p>\n<p>absolutely innocent.  Her   absence was not willful and  deliberate.<\/p>\n<p>        2.     The   learned   counsel   for   the   petitioner   submits   that   the<\/p>\n<p>petitioner is willing to appear before the learned Magistrate.  But she<\/p>\n<p>apprehends  that her     application  for bail  may not be considered  by<\/p>\n<p>the   learned   Magistrate   on   merits,   in   accordance   with   law   and<\/p>\n<p>expeditiously. It  is  in  these  circumstances  prayed   that appropriate<\/p>\n<p>directions may be issued to release the petitioner on bail on the date<\/p>\n<p>of surrender itself.\n<\/p>\n<\/p>\n<p>        3.  It is certainly for the petitioner to  appear before the learned<\/p>\n<p>Magistrate and   explain  to the  learned Magistrate the  circumstances<\/p>\n<p>under   which   she   could   not   earlier   appear   before   the   learned<\/p>\n<p>Crl.M.C.No.  2146 of   2007<\/p>\n<p><span class=\"hidden_text\">                                                2<\/span><\/p>\n<p>Magistrate.   I have no reason to assume that the learned Magistrate would<\/p>\n<p>not consider the application for bail to be filed by the petitioner when she<\/p>\n<p>surrenders before the learned Magistrate, on merits, in accordance with law<\/p>\n<p>and expeditiously.   Every court must do the  same.   No special or specific<\/p>\n<p>direction   appears   to   be   necessary.     Sufficient   general   directions   have<\/p>\n<p>already   been   issued   by   this   Court   in   the   decision   in  <a href=\"\/doc\/147290035\/\">Alice   George    v.<\/p>\n<p>Dy.S.P. of Police<\/a>  (2003 (1) KLT 339).\n<\/p>\n<\/p>\n<p>           4.  This application  is accordingly dismissed.   I may however hasten<\/p>\n<p>to  observe  that if the petitioner appears before the learned Magistrate and<\/p>\n<p>applies   for   bail   after   giving     sufficient   prior   notice   to   the   Prosecutor   in<\/p>\n<p>charge of the case, the learned Magistrate  must  proceed to pass  orders on<\/p>\n<p>merits, in accordance with law and expeditiously &#8211; on the date of surrender<\/p>\n<p>itself.\n<\/p>\n<\/p>\n<p>           5.  Hand over the order.\n<\/p>\n<\/p>\n<p>                                                              (R.
