The  third respondent in the said O.A.  is\t the<br \/>\nappellant.   To\t appreciate  the question  arising  in\tthis<br \/>\nappeal, we shall briefly state the facts of the case.  Under<br \/>\nthe  Tamil Nadu Agricultural Produce Markets Act, 1959\t[Act<br \/>\nNo.23  of 1959] (for short `the Act) various district Market<br \/>\nCommittees  came into being.  The appellant was appointed as<br \/>\nJunior\tAssistant  in the Market Committee, Madurai on\tJuly<br \/>\n22,  1976.   By\t an order issued on November  17,  1981\t the<br \/>\nGovernment  of\tTamil  Nadu declared that  all\tthe  persons<br \/>\nworking\t  in  various  district\t  Market   Committees\twere<br \/>\nGovernment  servants  or  would\t be  treated  as  Government<br \/>\nservants with effect from that date.  In 1982-83, there were<br \/>\n17  vacancies of Supervisors in Thanjavur Market  Committee.<br \/>\nAfter  calling\tfor  options  from  the\t eligible  staff  of<br \/>\ndistrict  Market  Committees, the Director  of\tAgricultural<br \/>\nMarketing,  Trichirapalli  transferred the  appellant  along<br \/>\nwith   others  to  Thanjavur   Market  Committee  for  their<br \/>\nappointment  as\t Supervisors.  The Market  Committee  passed<br \/>\nResolution  No.12\/82-83\t on  17.3.83   appointing  them\t  as<br \/>\nSupervisors  and  on  March  18,  1983\tin  Proceeding\tNo.1<br \/>\nE1\/893\/83,  the\t Secretary  of\tThanjavur  Market  Committee<br \/>\nissued\torders of their appointment.  The appellant is shown<br \/>\nat   Sl.No.14  in  the\t said  proceedings.   In  Proceeding<br \/>\nNo.E1\/13639\/84\tdated 26.7.84 issued by the Secretary of the<br \/>\nsaid market Committee, the services of the appellant as well<br \/>\nas  the other Supervisors were regularised with effect\tfrom<br \/>\n23.12.81  pursuant  to\tthe Resolution No.139\/84-84  of\t the<br \/>\nMarket\tCommittee dated 21.7.84.  Thereafter, the  Thanjavur<br \/>\nMarket\tCommittee  by  its   Resolution\t No.229\/84-85  dated<br \/>\n22.9.84\t declared the probation of the appellant with effect<br \/>\nfrom  24.3.83 (forenoon).  It appears that the Government of<br \/>\nTamil  Nadu  issued orders in GOMs No.194 Agriculture  dated<br \/>\nMarch  15, 1991 treating each District Market Committee as a<br \/>\nseparate   unit.   As  an  upshot  of  that  order  of\t the<br \/>\nGovernment,  the  Director of Agricultural Marketing  issued<br \/>\nproceeding  on\tJune  28,1991 purporting to  repatriate\t the<br \/>\nappellant  to  his  parent Market Committee,  Madurai.\t The<br \/>\nappellant   made  a  representation  to\t the   Director\t  of<br \/>\nAgricultural Marketing against his repatriation and by order<br \/>\ndated  9.7.91  in  Proceeding No.A4.16887\/91,  the  Director<br \/>\ncancelled  his earlier proceedings of 28.6.91.\t Challenging<br \/>\nthe  correctness  of  the  proceeding\tof  July  9,   1991,<br \/>\nrespondents  4\tto 8 herein filed O.A.No.2605\/91 before\t the<br \/>\nTamil  Nadu Administrative Tribunal, Madras.  The O.A.\t was<br \/>\nallowed\t by the Tribunal on 19.6.92.  The appellant assailed<br \/>\nthe  validity of the order of the Tribunal before this Court<br \/>\nin  Civil Appeal No.4221\/93.  By judgment and order of\tthis<br \/>\nCourt  dated  September 7, 1994, the order of  the  Tribunal<br \/>\ndated 19.6.92 was set aside and the case was remanded to the<br \/>\nTribunal  for fresh disposal in accordance with law.   After<br \/>\nremand,\t on  January  11,1995,\t the  Tribunal\tallowed\t the<br \/>\napplication   of  the  said   respondents  holding  that  on<br \/>\nappointment  as Supervisor of Thanjavur Market Committee the<br \/>\nappellant  did\tnot  acquire any right\tand  his  subsequent<br \/>\nregularisation\tand completion of probation did not make him<br \/>\nthe  regular incumbent of Thanjavur Market Committee.\tThat<br \/>\norder  is  the\tsubject matter of the present  appeal.\t The<br \/>\ncontentions   of  Mr.T.\t  Raja,\t  learned  counsel  for\t the<br \/>\nappellant,  are\t that  the appointment of the  appellant  by<br \/>\ntransfer  as  Supervisor  under\t Rule\t203  of\t Tamil\tNadu<br \/>\nAgricultural Produce Market Rules, 1962 (for short `the 1962<br \/>\nRules&#8217;)\t and his subsequent regularisation would make him an<br \/>\nemployee  of  the  Thanjavur Market Committee and  for\tthat<br \/>\nreason\tdeclaration of completion of probation was also made<br \/>\nby the Committee.  The appellant was appointed as Supervisor<br \/>\nby  the\t competent authority in 1983 and that was  saved  by<br \/>\namendment  of  Rules in GOMs No.206  Agriculture  Department<br \/>\ndated 18.3.91.\tTherefore, the repatriation of the appellant<br \/>\nto  the parent Market Committee, Madurai was wholly  illegal<br \/>\nwhich  was  rightly  withdrawn by the Director as  such\t the<br \/>\nimpugned  order\t of the Tribunal is liable to be set  aside.<br \/>\nLearned\t counsel  appearing  for the  official\trespondents,<br \/>\nrespondents  1-\t 3,  submitted\tthat  the  transfer  of\t the<br \/>\nappellant from Market Committee, Madurai to Thanjavur Market<br \/>\nCommittee  by  the Director did not make him an employee  of<br \/>\nThanjavur  Market Committee;  he continued to have his\tlien<br \/>\nin   the   Market  Committee,\tMadurai;    his\t  subsequent<br \/>\nregularisation\ton the post of Supervisor and declaration of<br \/>\nprobation by Thanjavur Market Committee would not confer any<br \/>\nright,\twhatsoever, on him.  The Director committed error in<br \/>\nwithdrawing  the  order\t of repatriation  and  the  Tribunal<br \/>\ncorrected   the\t  illegality  by   allowing  the  O.A.\t  of<br \/>\nrespondents 4 to 8 herein.  Though service of notice of this<br \/>\nappeal\ton  respondents 4 to 8, petitioners in the O.A.,  is<br \/>\nreported  to be complete, yet they did not enter appearance.<br \/>\nThe  short question that arises for consideration is whether<br \/>\nin  the\t circumstances\tof  this case on  his  transfer\t and<br \/>\nappointment as Supervisor of the Thanjavur Market Committee,<br \/>\nthe  appellant became the employee of that Committee.\tHere<br \/>\nit  may be useful to refer to the relevant Rules.  Under the<br \/>\n1962 Rules each Market Committee was a separate unit.  While<br \/>\nso,  by\t order\tissued\tin GOMs\t No.2535  Agriculture  dated<br \/>\n17.11.81, the Government of Tamil Nadu declared the services<br \/>\nof  the\t employees  working  in\t  the  Market  Committee  as<br \/>\nGovernment  servants  w.e.f 17.11.81.  Rule 202 of the\tsaid<br \/>\nRules  empowered  the Director of Agricultural Marketing  to<br \/>\ntransfer  employees  of\t one market Committee to  any  other<br \/>\nmarket Committee.  In 1982-83, there were 17 vacant posts of<br \/>\nSupervisors  in\t Thanjavur Market Committee.   The  Director<br \/>\nhaving\tcalled\tfor options of the eligible candidates\tfrom<br \/>\nvarious\t district  Market Committees transferred 17  persons<br \/>\nincluding  the\tappellant  from\t  their\t respective   market<br \/>\nCommittees to Thanjavur Market Committee for being appointed<br \/>\nas  Supervisors.   Accordingly\tunder Rule 203 of  the\tsaid<br \/>\nRules,\t the  Thanjavur\t Market\t  Committee  appointed\t the<br \/>\nappellant  and\tothers as Supervisors and issued  orders  on<br \/>\n18.3.83.   On  26.7.84\tthe services of the  appellant\twere<br \/>\nregularised  by Thanjavur Market Committee and on 1.10.84 he<br \/>\nwas declared to have completed his probation satisfactorily.<br \/>\nUnder  the said Rules the Market Committee was competent  to<br \/>\nappoint\t Supervisors  of  that\tCommittee.   Therefore,\t the<br \/>\nappointment of the appellant as Supervisor was in accordance<br \/>\nwith  Rules  then  in force.  It is no doubt true  that\t the<br \/>\ntransfer  of the appellant was subject to certain conditions<br \/>\nbut  in view of his subsequent appointment as Supervisor  of<br \/>\nThanjavur Market Committee and thereafter his regularisation<br \/>\non  satisfactory  completion of probation, those  conditions<br \/>\nwould  not  affect his tenure.\tIn 1989, the  Government  of<br \/>\nTamil Nadu decided to constitute separate service called the<br \/>\nTamil  Nadu  Agricultural Marketing Subordinate Service\t and<br \/>\nmade  Rules  governing\tthat  service.\t In  GOMs  No.\t 470<br \/>\nAgriculture   dated   5.7.89  the   rules  for\tTamil\tNadu<br \/>\nAgricultural\tMarketing    Subordinate    Service    Rules<br \/>\n(hereinafter referred to as the `special Rules) were issued.<br \/>\nThus  a\t centralised  Tamil   Nadu  Agricultural   Marketing<br \/>\nSubordinate  Service  was  constituted\tof  which  all\t the<br \/>\nemployees  of  district\t market\t  Committee  were   members.<br \/>\nConsequently  the  employees of district  market  Committees<br \/>\nceased\tto be employees in separate units of District Market<br \/>\nCommittees.   By  Rule\t2,  the\t Special  Rules\t were  given<br \/>\nretrospective effect from November 17,1981.  The Director of<br \/>\nAgricultural Marketing was made the appointing authority for<br \/>\nthe  post of Supervisor under the Special Rules.  Since\t the<br \/>\nspecial\t rules\twere framed in 1989 and given  retrospective<br \/>\neffect\tfrom 17.11.81 and in the meanwhile many appointments<br \/>\nwere  made  by the Market Committees, the Government  issued<br \/>\norders first inserting Rule 7 in the special Rules providing<br \/>\nthat nothing contained in those rules shall adversely affect<br \/>\nthe appointments and promotions made under the provisions of<br \/>\n1962  Rules on and from 17.11.81 till 4.7.89.  Further\tRule<br \/>\n10  was\t added in the special Rules to ensure  that  nothing<br \/>\ncontained   in\tthose  Rules   shall  adversely\t affect\t any<br \/>\nappointment  and promotion already made under the provisions<br \/>\nof  the 1962 Rules.  In view of Rules 7 and 10, referred  to<br \/>\nabove,\tthe  appointment of the appellant by  the  Thanjavur<br \/>\nMarket\tCommittee which was valid under the 1962 Rules\tthen<br \/>\nin  force, remained valid even under the special Rules.\t  It<br \/>\nappears\t that the Government of Tamil Nadu issued orders  in<br \/>\nGOMs  194  on 15.3.91 directing that each  Market  Committee<br \/>\nshall  be  treated as separate unit.  The appellant who\t was<br \/>\nalready\t  working  as  a   Supervisor  in  Thanjavur  Market<br \/>\nCommittee  on  March  15,1991 was entitled  to\tcontinue  as<br \/>\nSupervisor  of\tthat Market Committee and he could not\thave<br \/>\nbeen  treated as employee of the District Market  Committee,<br \/>\nMadurai\t  in   which  he   was\tinitially  appointed.\t His<br \/>\nrepatriation  to  the District Market Committee, Madurai  on<br \/>\nthe  ground  that  it was his parent  Committee\t was  wholly<br \/>\nillegal\t for  the  simple  reason that\tafter  formation  of<br \/>\ncentralised Marketing Subordinate Service the concept of the<br \/>\nparent\t committee   and  the\t borrowing   Committee\t got<br \/>\nobliterated.   The  order of the Director  transferring\t the<br \/>\nappellant  to  District\t Market Committee,  Madurai  on\t the<br \/>\nground\tthat it was his parent Committee, in the absence  of<br \/>\nany  specific  rule  authorising him to do so,\twas  clearly<br \/>\nillegal.    The\t Director  was,\t  therefore,  justified\t  in<br \/>\nwithdrawing  the illegal order.\t The Tribunal, in our  view,<br \/>\nerred  in  not\ttreating the appellant as  employee  of\t the<br \/>\nThanjavur   Market  Committee  and  in\tholding\t  that\t his<br \/>\npromotion,  regularisation  and declaration of probation  as<br \/>\nSupervisor  by the Thanjavur Market Committee did no  confer<br \/>\nany  right  on\thim.  Mr.A.  Mariarputham,  learned  counsel<br \/>\nappearing  for\tthe  respondents,  however,  relied  on\t the<br \/>\njudgment of this Court in <a href=\"\/doc\/1981867\/\">M\/s.Onkarlal Nandlal vs.  State of<br \/>\nRajasthan &amp; Anr.<\/a>  [1985 (4) SCC 404].  That case arose under<br \/>\nthe  Rajasthan Sales Tax Act.  The question was whether\t the<br \/>\nsale  in question was inter-State sale or intra-State  sale.<br \/>\nThe  assessee  purchased  poppy seeds  against\tDeclarations<br \/>\nunder Form ST 17 which indicated that the purchases were for<br \/>\nthe purpose of resale within the State.\t But the sale of the<br \/>\ngoods though inside the State, was effected in the course of<br \/>\ninter-State  trade  and\t commerce.  The\t expression  `resale<br \/>\nwithin\tthe  State&#8217;  in Form No.ST 17, it was held  by\tthis<br \/>\nCourt,\tmust  be  read\tin the light of\t Explanation  II  to<br \/>\nSection\t 2(o)  of  the\tState\tAct.   The  Explanation\t  by<br \/>\nincorporating  the provisions of Section 4(2) of the Central<br \/>\nSales Tax Act, provided as to when a sale shall be deemed to<br \/>\nbe  a  sale  within  the  State.   It  was  laid  down\tthat<br \/>\nExplanation  II\t to Section 2(o) of the State Act had to  be<br \/>\ninterpreted  as\t if  Section  4(2) of the  Central  Act\t was<br \/>\nwritten\t out  verbatim in that Explanation and there was  no<br \/>\noccasion or need to refer to the Central Act from which that<br \/>\nincorporation  was made or to its purpose or context.\tThat<br \/>\njudgment   is  of  no  assistance   to\tthe  respondent\t  in<br \/>\ninterpreting  the  1962\t Rules\tor   special  Rules  or\t the<br \/>\namendment  made to those Rules.\t For the above reasons,\t the<br \/>\njudgment and order under appeal is set aside.
