Ravani for the petitioner and learned<br \/>\nadvocate Mr. M.G. Nagarkar for the respondents.\n<\/p>\n<p>2.\t\tIn<br \/>\nsubstance, the question which now survives after an order already<br \/>\npassed by this Court in Civil Application No.1491 of 2008 on<br \/>\n6.8.2008, whereby the petitioner was directed to pay an amount of<br \/>\nRs.5,54,191\/- under protest subject to final order that may be passed<br \/>\nin this petition, and the respondent-GIDC was directed to issue &#8216;No<br \/>\nDue Certificate&#8217;, is only about the rent, about which the claim of<br \/>\nthe petitioner is that the petitioner is not liable to pay as the<br \/>\npetitioner was deprived of enjoyment of the plot for &#8216;no fault&#8217; on<br \/>\nhis part.\n<\/p>\n<p>2.1.\t\tLearned<br \/>\nadvocate Mr. Ravani for the petitioner relied upon a decision of the<br \/>\nHon&#8217;ble the Apex Court in the matter of RAICHURMATHAM PRABHAKAR<br \/>\nAND ANOTHER Vs RAWATMAL DUGAR reported in (2004)4 Supreme<br \/>\nCourt Cases 766.\n<\/p>\n<p>3.\t\tWithout<br \/>\ngoing into all these aspects as they involve disputed questions of<br \/>\nfact, the parties are relegated to the remedy of filing civil suit in<br \/>\nthe matter and to raise all the contentions raised in this petition<br \/>\nor which may be related to the dispute involved in the matter. With<br \/>\nthis observation, petition is disposed of. Rule is discharged with no<br \/>\norder as to costs.
