JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 18\/03\/2011  \nORAL ORDER<\/pre>\n<p>1.\tThis<br \/>\npetition under Article 226 of the Constitution of India has been<br \/>\npreferred by Shri Khimjibhai son of Kamabhai Makwana, who is at<br \/>\npresent serving as Assistant Sub-Inspector of Police, with the<br \/>\nfollowing prayers :\n<\/p>\n<p>&#8220;A)\tYour<br \/>\nLordships may be pleased to admit and allow this application;\n<\/p>\n<p>B)\tYour<br \/>\nLordships may be pleased to issue a writ of certiorari or any other<br \/>\nappropriate writ, order or direction<br \/>\nand further be pleased to quash and set aside the impugned order<br \/>\ndated 9.9.2010 passed by the Superintendent of Police, Kutch Bhuj in<br \/>\nDP\/186\/Aa.Hu\/Khimji\/5067\/10 at Annexure-A;\n<\/p>\n<p>\t\t\t\tor<\/p>\n<p>\tYour<br \/>\nLordships may be pleased to issue a writ of mandamus or any other<br \/>\nappropriate writ, order or direction<br \/>\nand be pleased to direct the respondent no.2 &#8211; Deputy Inspector<br \/>\n General of Police, Border Range, Bhuj-Kutch to decide forthwith the<br \/>\nappeal preferred by the present petitioner against the impugned order<br \/>\nannexed at Ann.:A in accordance with law.\n<\/p>\n<p>D)\tPending<br \/>\nadmission, hearing and final disposal of this petition, Your<br \/>\nLordships may be pleased to stay the implementation, execution and<br \/>\noperation of the impugned order dated 9.9.2010 passed by the<br \/>\nSuperintendent of Police, Kutch Bhuj in DP\/186\/Aa.Hu\/Khimji\/5067\/10<br \/>\nat Annexure-A;\n<\/p>\n<p>E)\tYour<br \/>\nLordships may be pleased to grant such other and further reliefs that<br \/>\nmay be deemed fit and proper in the facts and circumstances of the<br \/>\ncase;&#8221;\n<\/p>\n<p>2.\tIt<br \/>\nappears that the petitioner is facing a departmental inquiry. During<br \/>\nthe course of inquiry, the Superintendent of Police, Kutch-Bhuj<br \/>\npassed impugned order dated 9.9.2010, against which the petitioner<br \/>\npreferred an appeal. As the petitioner is due to superannuate on<br \/>\n31.3.2011 and as the appeal was not decided, he approached the High<br \/>\nCourt by filing Special Civil Application No.15233\/2010. The said<br \/>\npetition was disposed of, by order dated 6.12.2010 with a direction<br \/>\nto respondent No.2 to decide the appeal dated 3.10.2010 on, or<br \/>\nbefore, 28.2.2011. The said appeal has been decided on 4.2.2011,<br \/>\nagainst the petitioner. While passing the said order the Appellate<br \/>\nAuthority has noted that under the provisions of Section-27(A) of the<br \/>\nBombay Police Act, 1951, it is not mandatory for the competent<br \/>\nauthority to decide the Revision Application, if any, preferred<br \/>\nagainst the appellate order. As the petitioner has preferred a<br \/>\nRevision Application before respondent No.2 on 13.3.2011, he<br \/>\napprehends that due to the above-mentioned stipulation in the order<br \/>\ndated 4.2.2011, the Revision Application will not be heard, or<br \/>\ndecided, before the petitioner retires on 31.3.2011.\n<\/p>\n<p>3.\tHaving<br \/>\nheard Shri Khimjibhai son of Kamabhai Makwana, the petitioner,<br \/>\nparty-in-person and perused the provisions of Section-27(A) of the<br \/>\nBombay Police Act, there does not appear to be any legal bar in<br \/>\ndeciding the Revision Application of the petitioner.\n<\/p>\n<p>4.\tWithout<br \/>\nentering into the merits of the case, this Court, therefore, finds it<br \/>\nappropriate to direct, on the facts and in the circumstances of the<br \/>\ncase and in the interest of justice, that the Revision Application<br \/>\npreferred by the petitioner before respondent No.2, may be decided by<br \/>\nthe said respondent before 31.3.2011, as the petitioner would<br \/>\nsuperannuate on that date.\n<\/p>\n<p>\tThe<br \/>\npetition is disposed of, in the above terms.\n<\/p>\n<p>\tDirect<br \/>\nService of this order, today, is permitted.\n<\/p>\n<p>(Smt.\n<\/p>\n<p>Abhilasha Kumari, J.)<\/p>\n<p>~gaurav~<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Khimjibhai vs State on 18 March, 2011 Author: Abhilasha Kumari,&amp;Nbsp;
