GOVERNMENT\nPLEADER for Petitioner(s) : 1, \nMR PADMRAJ K JADEJA for\nRespondent(s) : 1, \n=================================================\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE K.M.THAKER\n\t\t\n\t\n\n \n\nDate\n: 18\/02\/2011  \nORAL ORDER<\/pre>\n<p>\tHeard<br \/>\nMs. Thakkar, learned AGP, for the petitioner and Mr. Jadeja, learned<br \/>\nadvocate for the respondent.\n<\/p>\n<p>\tMs.\n<\/p>\n<p>Thakkar, learned AGP, has referred to the statement of claim and the<br \/>\ndeposition of the respondent and submitted that the respondent has,<br \/>\nin his statement of claim as well as in his deposition, admitted that<br \/>\nhe was working with the petitioner as a daily wager. She further<br \/>\nsubmitted that either in the statement of claim or during his<br \/>\ndeposition, the respondent has not claimed and asserted that he had<br \/>\nput in work for 240 days during his tenure in any span of 12 months.<br \/>\nDespite absence of such assertion and relevant evidence coupled with<br \/>\nthe fact that the respondent had not given any application for<br \/>\nproduction of any document by the petitioner employer, there was no<br \/>\nevidence to establish that the respondent had worked for 240 days in<br \/>\nany span of 12 months and yet the Labour Court has, without<br \/>\nconsidering the said aspect, directed the petitioner to reinstate the<br \/>\nrespondent on the ground that there is breach of Section 25(F) of the<br \/>\nAct. She has also referred to the statement at page-64 showing the<br \/>\nworking days of the respondent.\n<\/p>\n<p>\tOn<br \/>\nperusal of the award, it, prima facie, appears that the said aspect<br \/>\nhas not been duly taken into account by the Labour Court before<br \/>\nholding that breach of Section 25(F) was committed while terminating<br \/>\nthe service of the petitioner.\n<\/p>\n<p>\tHence,<br \/>\nRULE.\n<\/p>\n<p>\tThe<br \/>\nprayer for interim relief seeking stay of the implementation of the<br \/>\nimpugned award is not granted. It is, however, clarified that the<br \/>\nreinstatement of the respondent will not create any right or equity<br \/>\nin favour of the respondent and it will be subject to the result of<br \/>\nthe petition.
