DAVE\n\t\t\n\t\n\n \n\nDate\n: 07\/10\/2010 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>1.\tThis<br \/>\nappeal, under Section 378 of the Code of Criminal Procedure, is filed<br \/>\nagainst the order dated 12.04.1991 passed by the learned Metropolitan<br \/>\nMagistrate, Court No.8, Ahmedabad in Criminal Case No.5 of 1988 by<br \/>\nwhich, the respondents\/original accused came to be acquitted of the<br \/>\noffences punishable under Sections 7 and 16(1A)(I) of the Prevention<br \/>\nof Food Adulteration Act, 1944. (for short, the  Act .).\n<\/p>\n<p>2.\tLearned<br \/>\nA.P.P. Ms.Shah submits that the order of acquittal passed by the<br \/>\nlearned Magistrate is contrary to law and the evidence on record<br \/>\ninasmuch as report of Central Food Laboratory reveal that cow milk<br \/>\ncarried by the accused was found to have been adulterated. Besides,<br \/>\nprocedure, as established under the law, was followed by the<br \/>\nauthority and the learned Magistrate erred in holding that the<br \/>\nAhmedabad Municipal Corporation namely, the local authority, under<br \/>\nthe Act, had no authority for giving sanction under Section 20 of the<br \/>\nAct.\n<\/p>\n<p>3.\tOn<br \/>\nperusal of the Record and Proceedings along with the submissions made<br \/>\nby the learned A.P.P., I am of the opinion that the prosecution, as<br \/>\nrightly held by the learned Magistrate, could not prove its case<br \/>\nbeyond reasonable doubt. Besides, the complaint was filed by the<br \/>\nauthority and Central Food Laboratory had examined the sample after<br \/>\ntwo and half years.\n<\/p>\n<p>4.\tConsidering<br \/>\nthe above aspect and the defence of the accused and the findings of<br \/>\nthe learned Magistrate, that mandatory provisions of Section 10(7) of<br \/>\nthe Act, were breached and thus, it cannot be said that the judgment<br \/>\nand order of acquittal passed by the learned Magistrate requires any<br \/>\ninterference by this Court in exercise of jurisdiction under Section<br \/>\n378 of the Code of Criminal Procedure.\n<\/p>\n<p>5.\tConsidering<br \/>\nthe overall facts and circumstances of the case, this appeal fails<br \/>\nand accordingly dismissed. No order as to costs. Record and<br \/>\nProceedings be sent back forthwith.\n<\/p>\n<p>(ANANT<br \/>\nS.
