    Petitioner is the accused and first respondent<\/p>\n
the complainant in S.T.165\/2006 on the file of<\/p>\n
Judicial  First   Class   Magistrate   II   (Forest<\/p>\n
Offences), Manjeri.  Case of the first respondent<\/p>\n
was that petitioner approached him for purchase of<\/p>\n
gold ornaments and gold ornaments was arranged from<\/p>\n
one Jaffer a friend and he purchased  them and then<\/p>\n
sold  to   the   petitioner  for   an   amount  of<\/p>\n
Rs.2,03,000\/-  out   of   which   petitioner   paid<\/p>\n
Rs.37,000\/- in cash and towards the balance issued<\/p>\n
Ext.P1 post dated cheque drawn in his account<\/p>\n
maintained in  Manjeri Co-operative Bank.   When it<\/p>\n
was presented for encashment, it was dishonoured<\/p>\n
for want of sufficient funds.    Inspite of notice<\/p>\n
served on the petitioner, demanding the amount<\/p>\n
covered by Ext.P1, he did not pay the amount and<\/p>\n
thereby committed the offence under section 138 of<\/p>\n
CRRP 3441\/2008              2<\/span><\/p>\n
Negotiable Instruments Act.    Petitioner pleaded not<\/p>\n
guilty.       Learned Magistrate on the evidence of<\/p>\n
first respondent as PW1 and Jaffer from whom the<\/p>\n
gold ornaments were purchased as PW2 and Exts.P1 to<\/p>\n
P7 and the evidence of the petitioner as DW1 and<\/p>\n
Ext.D1 advertisement in the      newspaper, found the<\/p>\n
petitioner guilty.     He was convicted and sentenced<\/p>\n
to simple imprisonment for three months and a<\/p>\n
compensation of Rs.1,66,000\/- and in default simple<\/p>\n
imprisonment for two months.    Petitioner challenged<\/p>\n
the conviction and sentence before    Sessions Court,<\/p>\n
Manjeri in Crl.A.313\/2007.     Learned Sessions Judge<\/p>\n
on   reappreciation     of  evidence   confirmed  the<\/p>\n
conviction      but   modified   the    sentence   to<\/p>\n
imprisonment     till  rising  of  the  court  and  a<\/p>\n
compensation of Rs.1,66,000\/- and in default simple<\/p>\n
imprisonment for two months.    The revision is filed<\/p>\n
challenging the conviction and sentence.<\/p>\n
     2.     Learned counsel appearing for petitioner<\/p>\n
was heard.\n<\/p>\n
     3.     The argument of the learned counsel   for<\/p>\n
CRRP 3441\/2008              3<\/span><\/p>\n
petitioner is that courts below did not properly<\/p>\n
appreciate the evidence.      It was pointed out that<\/p>\n
the inherent improbability of the case was not<\/p>\n
properly      born  in  mind while  appreciating   the<\/p>\n
evidence.     It was also  argued that evidence of PW1<\/p>\n
was that Ext.P1 cheque was written and brought by<\/p>\n
the petitioner to the shop of first respondent and<\/p>\n
when the case is that the cheque was issued towards<\/p>\n
the balance amount       payable for the purchase of<\/p>\n
gold   ornaments,    a  cheque  could  not  have  been<\/p>\n
written and brought to the shop of PW1 without<\/p>\n
ascertaining the price of the goods which could be<\/p>\n
fixed only after purchasing the gold ornaments and<\/p>\n
therefore        evidence of  PW1  should  have   been<\/p>\n
disbelieved and so the conviction of the petitioner<\/p>\n
is   not     sustainable.   Learned  counsel   finally<\/p>\n
submitted     that  in  any  case  petitioner  may  be<\/p>\n
granted six months time to pay the amount as<\/p>\n
directed by the Sessions Judge.\n<\/p>\n
     4.    The evidence of first respondent as PW1 was<\/p>\n
fully corroborated by the evidence of PW2. Evidence<\/p>\n

of    Pws.1 and 2 establish that for the purpose of<\/p>\n
selling the gold ornaments to the     petitioner, on<\/p>\n
his request, gold ornaments of PW2 was purchased by<\/p>\n
PW1 and was then sold to the petitioner.    Evidence<\/p>\n
of Pws.1 and 2 also establish that towards the<\/p>\n
value of the gold ornaments Rs.37,000\/- was paid by<\/p>\n
the petitioner and for the balance Ext.P1 cheque<\/p>\n
was issued.    Though PW1 deposed that Ext.P1 cheque<\/p>\n
was not written in his presence and it was written<\/p>\n
and    brought  to   the  shop,  the   improbability<\/p>\n
canvassed by the counsel was cleared         by the<\/p>\n
further evidence of PW1 on reexamination stating<\/p>\n
that after fixing the price to be paid, petitioner<\/p>\n
had brought the cheque written and then    signed in<\/p>\n
the presence.    I find no reason to disbelieve the<\/p>\n
evidence of PW1 corroborated by   PW2 and   accepted<\/p>\n
by the court below.    Though petitioner has a case<\/p>\n
that along with some other cheques Ext.P1 cheque<\/p>\n
was also lost and Ext.D1 advertisement was pressed<\/p>\n
into   service,  courts  below  rightly  disbelieved<\/p>\n
Ext.D1 as the publication was subsequent to the<\/p>\n
CRRP 3441\/2008              5<\/span><\/p>\n
dishonour of Ext.P1 cheque and also because      only<\/p>\n
the number of the dishonoured cheque was mentioned<\/p>\n
therein eventhough case of the petitioner is that<\/p>\n
several cheques were lost.      In such circumstance,<\/p>\n
on appreciating the evidence, I find no reason to<\/p>\n
differ with the findings of the courts below.<\/p>\n
Evidence      establish   that   Ext.P1   cheque   was<\/p>\n
dishonoured for want of sufficient funds and first<\/p>\n
respondent has complied with all the statutory<\/p>\n
formalities        provided  under   section  138   of<\/p>\n
Negotiable Instruments Act.        Conviction of the<\/p>\n
petitioner for the offence under section 138 of<\/p>\n
Negotiable Instruments Act is therefore perfectly<\/p>\n
legal.\n<\/p>\n
     5.     Then the only question is with regard to<\/p>\n
the sentence.     The substantive sentence was reduced<\/p>\n
by the Sessions Judge to imprisonment till rising<\/p>\n
of the court.     The compensation was confirmed.  But<\/p>\n
in view of the decision of the Apex Court that when<\/p>\n
compensation is awarded under section 357(3) of the<\/p>\n
Code of Criminal Procedure, a default sentence<\/p>\n
CRRP 3441\/2008            6<\/span><\/p>\n
cannot be awarded the sentence is not legal to that<\/p>\n
extent. That defect could be cured if the sentence<\/p>\n
is modified to a fine with a direction to pay the<\/p>\n
compensation to first respondent under sub section<\/p>\n
(1)   of    Section 357  of  the  Code  of  Criminal<\/p>\n
Procedure.\n<\/p>\n
     Criminal Revision Petition is allowed in part.<\/p>\n
The conviction for the offence under section 138 of<\/p>\n
Negotiable Instruments Act is confirmed.    Sentence<\/p>\n
is modified to imprisonment till rising of the<\/p>\n
court and a fine of Rs.1,66,000\/- to be paid within<\/p>\n
six   months    from today  and  in  default  simple<\/p>\n
imprisonment for two months.   On realisation of the<\/p>\n
fine, it shall be paid to first respondent as<\/p>\n
compensation    under section   357(1) of  Code   of<\/p>\n
Criminal Procedure.      Petitioner is directed to<\/p>\n
appear before the Magistrate on the expiry of six<\/p>\n
months from today.\n<\/p>\n<\/p>\n
