Tribunal is justified in the eye of law, in the facts and the<br \/>\ncircumstances of the case, while confirming and upholding the<br \/>\nduty-amount, reducing the penalty to 25% of the said duty-amount if<br \/>\npaid within thirty days of the receipt of the impugned order dated<br \/>\n13.01.2009?\n<\/p>\n<p>[2]\tWhether<br \/>\nthe Ld. Tribunal is justified in the eye of law, in the facts and the<br \/>\ncircumstances of the case, in holding that the said Ld. CESTA<br \/>\nTribunal has the discretionary authority under the Statute to reduce<br \/>\nthe penalty to 25%, which is imposed under Section 11AC of the<br \/>\nCentral Excise Act, 1944, by granting the fresh period of thirty days<br \/>\nto the said unit for the said period from the receipt of the impugned<br \/>\norder dated 13.01.2009?\n<\/p>\n<p>[3]\tWhether<br \/>\nthe Ld. Tribunal is justified in the eye of law, in the facts and the<br \/>\ncircumstances of the case, in the interpretation and the application<br \/>\nof the statutory provisions contained in section 11AC and section 35F<br \/>\nof the Central Excise Act, 1944?\n<\/p>\n<p>[4]\tWhether<br \/>\nthe Ld. Tribunal is justified in the eye of law, in the facts and the<br \/>\ncircumstances of the case, in considering the statutory provisions of<br \/>\nsection 11AC of the Central excise Act, 1944 as the directory in<br \/>\nnature rather than the mandatory in nature, inspite of the judgement<br \/>\nof the Hon&#8217;ble Apex Court dated 29.9.2008 delivered in the matter of<br \/>\n<a href=\"\/doc\/95472186\/\">Union of India v. M\/s Dharamendra Textile Processors<\/a> (2008 &#8211;<br \/>\nTIOL-192-SC-CX-LB)?\n<\/p>\n<p>[5]\tWhether<br \/>\nthe Ld. Tribunal is justified in the eye of law, in the facts and the<br \/>\ncircumstances of the case, in reducing the penalty to 25% of the duty<br \/>\namount if paid within thirty days from the receipt of the impugned<br \/>\norder dated 13.01.2009, especially when the said unit has failed to<br \/>\nmake the payment of the duty amount imposed under section 12A(2),<br \/>\ninterest payable thereon under section 11AB, along with the penalty<br \/>\nof 25% of the said duty amount liable under section 11AC of the<br \/>\nCentral Excise Act, 1944 within the period of thirty days from the<br \/>\ncommunication of the Order-in-Original dated 29.12.2006 and\/or the<br \/>\nShow cause notice dated 08.12.2005?&#8221;\n<\/p>\n<p>Heard<br \/>\n\tMr.Gaurang Bhatt, learned Standing Counsel for the appellant-revenue<br \/>\n\tand perused the orders passed by the authorities below.\n<\/p>\n<p>There<br \/>\n\tis no controversy about the fact that the issue involved in the<br \/>\n\tpresent tax appeal is squarely covered by the decision of this Court<br \/>\n\tin the case of Commissioner of Central Excise &amp; Customs,<br \/>\n\tSurat-II v. Mahalaxmi Industries, 2010 (2) GLH 116.\n<\/p>\n<p>In<br \/>\n\tview of the above decision of this Court, we are of the view that no<br \/>\n\tsubstantial question of law arises out of the impugned order of the<br \/>\n\tTribunal.
