Justice K.T.SANKARAN\n\n Dated :30\/03\/2009\n\n O R D E R\n                        K.T.SANKARAN, J.\n                    ---------------------------------------\n                      Tr.P.(C) No.72 OF 2009\n                    ---------------------------------------\n              Dated this the 30th day of March, 2009\n\n\n                               O R D E R\n<\/pre>\n<p>    The plaintiff in O.S.No.227\/1992 on the file of the Sub<\/p>\n<p>Court, Manjeri seeks transfer of the suit to any of the Sub<\/p>\n<p>Courts at Kozhikode.\n<\/p>\n<p>    2. The reasons stated for transfer are the following :<\/p>\n<p>      i) The daughter of the petitioner is a practicing<\/p>\n<p>           lawyer in Manjeri courts.\n<\/p>\n<p>      ii) The husband of the fourth respondent is also a<\/p>\n<p>           practicing lawyer in Manjeri courts. He is very<\/p>\n<p>           influential.\n<\/p>\n<p>      iii) It will be embarrassing for the plaintiff and her<\/p>\n<p>           daughter if the case is tried before the Sub<\/p>\n<p>           court, Manjeri.\n<\/p>\n<p>      iv) An application for removal of the case from the<\/p>\n<p>           ready list was filed since the physical condition<\/p>\n<p>           of the petitioner did not permit her to be<\/p>\n<p>           examined in court. That application was<\/p>\n<p>           dismissed. Thereafter, she filed an application<\/p>\n<p>Tr.P.(C) No.72 of 2009<br \/>\n<span class=\"hidden_text\">                                    2<\/span><\/p>\n<p>              to    examine    her   on   commission.    That<\/p>\n<p>              application was allowed. At the time of hearing<\/p>\n<p>              of the application, various observations were<\/p>\n<p>              made by the learned Judge which caused<\/p>\n<p>              reasonable apprehension in the mind of the<\/p>\n<p>              petitioner that she may not get justice, if the<\/p>\n<p>              suit is tried in that court. The attitude of the<\/p>\n<p>              learned Judge was against the petitioner and<\/p>\n<p>              she reasonably believes that the learned Judge<\/p>\n<p>              is prejudiced against her.\n<\/p>\n<p>         3. The transfer petition is seriously opposed by<\/p>\n<p> respondents 1 to 5. The counsel for respondents 1 to 5 pointed<\/p>\n<p> out that the suit was filed in 1992. Written statement was filed<\/p>\n<p> in 1993. Issues were settled in 1995 and on five occasions, the<\/p>\n<p> plaint was amended. It is also pointed out that as per the order<\/p>\n<p> in I.A.No.181\/2009, the plaintiff was allowed to be examined<\/p>\n<p> on     commission.      A   commissioner   was    appointed.  The<\/p>\n<p> examination of the petitioner\/plaintiff was fixed to be held on<\/p>\n<p> 08.03.2009.        The  plaintiff filed  the  chief  affidavit on<\/p>\n<p> 19.02.2009. All the lawyers appearing in the case were ready<\/p>\n<p>Tr.P.(C) No.72 of 2009<br \/>\n<span class=\"hidden_text\">                                  3<\/span><\/p>\n<p> for examination of the plaintiff. However, stating that the<\/p>\n<p> plaintiff was laid up, adjournment was sought for and that<\/p>\n<p> request was allowed. The Transfer Petition was filed in this<\/p>\n<p> background.\n<\/p>\n<p>         4. There is no case that the daughter of the petitioner or<\/p>\n<p> the husband of the fourth respondent started practice recently<\/p>\n<p> in Manjeri courts. They started practice several years ago. The<\/p>\n<p> reason stated that the daughter of the petitioner and the<\/p>\n<p> husband of the fourth defendant are Advocates practising in<\/p>\n<p> Manjeri courts is as such not a reason for a transfer of the<\/p>\n<p> case. The learned Subordinate Judge do not find any<\/p>\n<p> embarrassment in taking up the case for trial and no request<\/p>\n<p> was made by the learned Sub Judge for transfer of the case.<\/p>\n<p> Therefore on that ground, I do not think that the request for<\/p>\n<p> transfer can be entertained. The allegation that the learned<\/p>\n<p> Sub Judge made various observations which caused reasonable<\/p>\n<p> apprehension in the mind of the petitioner that she may not<\/p>\n<p> get justice from that court is not substantiated. The statement<\/p>\n<p> made by the petitioner is disputed by the respondents. No<\/p>\n<p> specific incident has been pointed out. The allegations are<\/p>\n<p>Tr.P.(C) No.72 of 2009<br \/>\n<span class=\"hidden_text\">                                   4<\/span><\/p>\n<p> vague and general. On the basis of an allegation for allegation<\/p>\n<p> sake, a case cannot be transferred. To my mind, the reasons<\/p>\n<p> stated by the petitioner for transfer of the case are not<\/p>\n<p> sufficient for allowing the application for transfer. The<\/p>\n<p> Transfer Petition fails and it is accordingly dismissed.<\/p>\n<p>         5.    The learned senior counsel appearing for the<\/p>\n<p> petitioner submitted that the petitioner may be afforded a<\/p>\n<p> reasonable opportunity to adduce evidence. The court below<\/p>\n<p> shall consider the same and grant reasonable opportunity to<\/p>\n<p> the petitioner to adduce evidence.
