Whether the judgment should be                    NO\n         reported in the Digest?\n\n\nANIL KUMAR, J.\n<\/pre>\n<p>*<\/p>\n<p>       The petitioner has challenged the order dated 28th May, 2010<\/p>\n<p>in TA 1471\/2009 titled as R.C. Dubey Vs. UOI &amp; Anr., whereby the<\/p>\n<p>discharge simplicitor of the respondent was held to be punitive and<\/p>\n<p>the order dated 5th July, 1995 discharging the respondent was<\/p>\n<p>quashed and set aside and the petitioner was directed to reinstate<\/p>\n<p>the respondent as Principal of Navodaya Vidyalaya in the same rank<\/p>\n<p><span class=\"hidden_text\">WP(C) No. 7844\/2010                                         Page 1 of 5<\/span><br \/>\n and grade which he was holding when his services were terminated<\/p>\n<p>and he was discharged.\n<\/p>\n<\/p>\n<p>       The Tribunal in para 24 of the impugned order had given the<\/p>\n<p>following directions:-\n<\/p>\n<\/p>\n<blockquote><p>               &#8220;24. In the result, the TA is allowed in the following<br \/>\n               terms:\n<\/p><\/blockquote>\n<blockquote><p>               (i) The impugned order dated 5.7.1995 are quashed<br \/>\n               and set aside and we direct the Respondents to<br \/>\n               reinstate the Applicant as principal of one of the<br \/>\n               Navodaya vidyalayas in the same rank and grade he<br \/>\n               was holding when his services were terminated.\n<\/p><\/blockquote>\n<blockquote><p>               (ii) The respondents would, however, be at liberty to<br \/>\n               initiate departmental enquiry against the Applicant for<br \/>\n               the alleged misconducts, if so advised.\n<\/p><\/blockquote>\n<blockquote><p>               (iii) With regard to the consequential salary benefits, it<br \/>\n               is noted that between 1995 and 2010, the Applicant<br \/>\n               has lost his prime service period of about 15 years and<br \/>\n               deprived of his salary and associated allowances.<br \/>\n               During the hearing, Counsel for Applicant informs that<br \/>\n               during the said period, the Applicant has to eke out<br \/>\n               his livelihood by taking tuitions of students and was<br \/>\n               earning something but not to the extent that he would<br \/>\n               have got from his salary and allowances. In this<br \/>\n               peculiar circumstances of the case, it is not possible to<br \/>\n               direct the Respondents to pay the full back wages to<br \/>\n               the Applicant. We, therefore, direct the Respondents<br \/>\n               to pay a lump sum amount of Rs.3 lakhs, which in our<br \/>\n               considered opinion, the Applicant would be entitled to.\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\">WP(C) No. 7844\/2010                                            Page 2 of 5<\/span><\/p>\n<blockquote><p>                (iv) The Respondents are directed to implement the<br \/>\n               above directions (i) and (iii) within a period of 6 weeks<br \/>\n               from the date of receipt of the certified copy of this<br \/>\n               order.&#8221;<\/p><\/blockquote>\n<p>       The learned counsel for the petitioner has contended that since<\/p>\n<p>the respondent was a probationer, therefore, pursuant to the order<\/p>\n<p>dated 28th May, 2010, he is to be reinstated as a probationer in the<\/p>\n<p>same rank and grade he was holding when he was discharged. The<\/p>\n<p>learned counsel for the petitioner on instruction has contended that<\/p>\n<p>the petitioner shall implement the order of Tribunal and the petition<\/p>\n<p>was filed as an impression had been gathered that the petitioner<\/p>\n<p>perhaps has to be reinstated as a permanent teacher.<\/p>\n<p>       There cannot be doubt that by impugned order the Tribunal<\/p>\n<p>had ordered reinstatement of the respondent as principal of one of<\/p>\n<p>the Navodaya vidyalayas in the same rank and grade he was holding<\/p>\n<p>when his services were terminated. When the services of the<\/p>\n<p>respondent were terminated he was a probationer, therefore he is to<\/p>\n<p>be reinstated as probationer. The learned counsel for the respondent<\/p>\n<p>also does not oppose this proposition.\n<\/p>\n<\/p>\n<p>        The learned counsel for the petitioner on instructions, states<\/p>\n<p>that the petitioner shall comply with the order dated 28th May, 2010<\/p>\n<p><span class=\"hidden_text\">WP(C) No. 7844\/2010                                           Page 3 of 5<\/span><br \/>\n within four weeks. Consequently, the petitioner shall reinstate the<\/p>\n<p>respondent and will also be entitled to initiate departmental inquiry<\/p>\n<p>afresh against the respondent for the alleged misconduct, if the<\/p>\n<p>petitioners will be so advised. The petitioner will also pay a sum of<\/p>\n<p>Rs.3 lakhs which was computed up till 2010, till the date of order, as<\/p>\n<p>the respondent was not given any emoluments for almost 15 years.<\/p>\n<p>This amount of three lakhs which was payable within six weeks of<\/p>\n<p>the order of the Tribunal has not been paid though the order of the<\/p>\n<p>Tribunal was not stayed by this Court in the writ petition. The<\/p>\n<p>learned counsel for the petitioner state that the amount in terms of<\/p>\n<p>the order of the Tribunal shall be now paid within four weeks.<\/p>\n<p>       Since the respondent was not paid the amount in compliance<\/p>\n<p>with the order of the Tribunal which was not stayed, the petitioner<\/p>\n<p>shall also consider whether any extra amount would be payable to<\/p>\n<p>the respondent sympathetically in the facts and circumstances.<\/p>\n<p>       Since the petitioner has consented to comply with the order of<\/p>\n<p>the Tribunal no further directions are required to the parties and the<\/p>\n<p>petitioner shall comply with the order of the Tribunal within four<\/p>\n<p>weeks.     The writ petition is disposed of with these direction.
