During the pendency of the proceedinge &#8216;  <\/p>\n<p>the Trial Court, the petitioner \ufb01led a    <\/p>\n<p>PCR No.180\/99 for the offeI1ce_s  <\/p>\n<p>committed under Section 89 of    <\/p>\n<p>Marks Act 1953 (for short fzaen. The  i\ufb02\ufb02ediebyvjthe<\/p>\n<p>petitioner in  ul\u00a7e&#8221;\u00a7dV\u00a7smissed for<br \/>\ndefauit vide omer&#8217;p_\u00ab\u00aba$zeep_  Aggrieved by this<\/p>\n<p>order of di55iIii3$el}&#8217;j5th\u00e9&#8217;: 1\u00a7&gt;e.titioner iseefoie this court in the<\/p>\n<p>present pef:it_io3:14\u00a7 &#8216; V&#8217; <\/p>\n<p>3. During the pendency of the civil<\/p>\n<p> }iteg%a&#8217;:;\u00a7:1;% the petitioner initiated criminal proceedings.<\/p>\n<p> the eespondents&#8217; in PCR1999. The order<\/p>\n<p> Esixeet in PCR No.18:()\/.19Q9 dglseloeeefjnfett despite <\/p>\n<p>su\ufb01cierlt time petitioner failed to pnesecete the proceedings<\/p>\n<p>(jLz\\;&#8217;\\,z<\/p>\n<p>and consequen\ufb02y the Trial Court under fhe impugned OI\ufb01\u00a7t%f&#8221;&gt;,.<\/p>\n<p>dismissed the complaint \ufb01led by the petitioner for  &#8221; <\/p>\n<p>Though the Aimpugeci order is dated  % 3 &#8212;<\/p>\n<p>present petition is \ufb01led before this co1x:v1&#8242;?t\u00bbAo:\u00bbi&#8217;   j_ <\/p>\n<p>only explanation o\ufb02ered by the pe\ufb01tioner..for._ehis  V&#8217;<\/p>\n<p>delay in \ufb01ling this petition and aleo\ufb02ifor noi  <\/p>\n<p>proceedings befon: the  Leon  &#8220;of &#8216;<\/p>\n<p>communication gap betweee  Except<br \/>\nthis 333511503 Of  ivis no other<br \/>\nconvincing    the petition and to<br \/>\nprovide   __ Having regexd to<br \/>\nthe mla\ufb01oexghigj  &#8216;the nature of o\ufb01ence<\/p>\n<p>a\ufb02eged and  %;sv:-:nVc ie_z:;cA:y&#8221;  disputes?
