This appeal coming on for hearingAAthiisi4id\u00a7?ly.,i the f<\/p>\n
delivered the following:\n<\/p>\n
Junems\ufb01g<\/p>\n
The Counsel for the ..appel’la:i–t,iVp_:was-\u00bb heard i substantially.<\/p>\n<\/p>\n
2. The ,appellan.t,:l._is  seeking
\nenhancement    had met with
\na motor   viofiaccident, he was aged 40
\nyears  a  and on account of the
\naccident,’  injuries to the right leg, right<\/p>\n
little, toe, rig1’it.,_:Vhann:1, Aleftdhip, fracture of femur. lnspite of<\/p>\n
Vsustairiieed. “ttjeatrr1e1ri’t,'” after incurring substantial medical<\/p>\n
  upon being discharged, he was found<\/p>\n
suffering.fr’orn a permanent disability, which was assessed<\/p>\n
 by a “rneidical practitioner at 40\u00b0\/0 to his lower limb. The<\/p>\n
 Tribunal accordingly computed compensation under several<\/p>\n
i  heads and awarded a total compensation of Rs.1,15,O00\/~<\/p>\n
@<\/p>\n
In so far as other heads, such as medical expenses<\/p>\n
are concerned, the Tribunal has awarded meagre arnount-s of<\/p>\n
Rs.6000\/– and 123.3000\/– towards medical air.-\u00e9igiideizkiy;–1:<\/p>\n
Rs.lOO\/- per day, and only Rs.bO()_pQ\/f towardvsiiiipairi it  <\/p>\n
suffering, though admittedly the iappellant\u00e9i’=ha.d*–.suffered;vi a<\/p>\n
serious injuries to several parts  his body. Thejjgfgre, _’j’thei
\nCounsel would seek all round enh’a.ncernent’ in alsubistantial<\/p>\n
measure .\n<\/p>\n
4. Whpilel\ufb02the   r’espondent–insurer
\nwould vehemently andlwould submit, that
\nthis was ‘a*’fitllAlca;se:i’:wherelithe’ins-urerlought to have preferred
\nan aPI3cal to ‘*eXorbitant amounts that have<\/p>\n
been granted _tol  “appellant in the face of glaring<\/p>\n
 circuijr1stances.’i ” ‘-1-Ie would point out, that the medical<\/p>\n
 ~praetitioAner-.4hav’ing assessed the disability at 40% to the<\/p>\n
blower’1iVr1~15;,._the”‘effective disability in relation to the whole<\/p>\n
body’  not exceed 10% by known standards applicable<\/p>\n
bland therefore, the Tribunal having adopted 25% in respect of<\/p>\n
 ‘disability for the purpose of computing compensation has<\/p>\n
resulted in a lopsided computation and has conferred an<\/p>\n
unintended bene\ufb01t upon the appellant.\n<\/p>\n
The fact that Rs.’75\/ ~ has been adopted  _<\/p>\n
is also immaterial in this regard, sinceany  if <\/p>\n
daily wage having been taken at Rs.’f\u00bb5\/ -bis made.’ good  if<\/p>\n
substantial amount of compensation
\nimpression that the disability   vi\ufb01ould be
\n25% in the face of disabilit\ufb01\/’ to ‘the; being\ufb02assessed
\nat 440\u00b0\/0, which again is   to the very
\nnature of  lit;  the appellant’s
\nleg is   th}eT_there is no material
\nevidence to  suffered any apparent
\ndisabilitvanidhe11ce;thi’s~ exaggerated assessment of<\/p>\n
disability by lithe medicial \u00abpractitioner. Hence, the claim for<\/p>\n
.i”addition–al compensation under the head of ‘loss of future<\/p>\n
 aearnintgvIcapacity\ufb02is not tenable.\n<\/p>\n
 ln*–iso”far as compensation awarded under other heads<\/p>\n
2 pgareiconcerned, the same cannot be characterised as meagre,<\/p>\n
  Tribunal having generously awarded compensation<\/p>\n
i ‘ “towards loss of future earning capacity, proceeded on the<\/p>\n
5<\/span><\/p>\n
same scale and has granted compensation, which the<\/p>\n
appellant hardly deserved. Hence, there is no ground”-.’for<\/p>\n
interference by this court.\n<\/p>\n
5. PM While the contention t.hat”t1\u00e9’3. :&1W3,’~1’d”‘\ufb01(3″.’\u00a31rdsVi”–V<\/p>\n
‘loss of future earning capacity’ is ba.sed._ on an..yinaccu:;atelV’i<\/p>\n
assessment, ought to be accented since-._lthellmrriedijcal
\npractitioner could not be held  inholdilng that
\nthe disability in respectllof_e_the would be 25%
\nwhen the disability in  was 40%
\nand the claigrril  Rs.75\/~\u00bb it can
\nhardly be   grant a wage different
\nfrom  hence, as rightly pointed by<\/p>\n
the Counsl\u00e91.._’for_ the }~\u00a7sp\u00a2’i;den:, the compensation towards<\/p>\n
\u00bb , the loss of future eavrning capacity is again on the higher side<\/p>\n
  any: -s.ho4rt’~fall, on the basis of the argument herein by<\/p>\n
 appellant, is made good by such higher<\/p>\n
amountshaving been granted.\n<\/p>\n
