RADHAKRISHNAN, J.\n\n  = = = = = = = = = = = = = = = = = = = = = = = =\n\n            W.P.(C).No.30832 of 2009-Y\n\n  = = = = = = = = = = = = = = = = = = = = = = = =\n\n      Dated this the 30th day of October, 2009.\n\n                     JUDGMENT\n<\/pre>\n<p>1.The petitioner complains that a few truck loads<\/p>\n<p> of M-sand belonging to him were detained by the<\/p>\n<p> police in the check post. He seeks release of<\/p>\n<p> lorry loads. He states that there is a complete<\/p>\n<p> standstill of the administrative procedure.<\/p>\n<p>2.If the material being transported is river sand,<\/p>\n<p> that may have to be dealt with in accordance with<\/p>\n<p> the   appropriate  law,    having  regard  to  the<\/p>\n<p> prohibition of movement of river sand. But, that<\/p>\n<p> matter has to gain the immediate attention of the<\/p>\n<p> District Collector. If the material is not river<\/p>\n<p> sand but only M-sand, that has to be handed over<\/p>\n<p> without further insisting that it may be river<\/p>\n<p> sand. Certainty in administrative procedure is a<\/p>\n<p> core angle on which rights of citizens would<\/p>\n<p><span class=\"hidden_text\">WPC30416\/09           -: 2 :-<\/span><\/p>\n<p> stand protected. There cannot also be any delay<\/p>\n<p> in such matters.\n<\/p>\n<p> For the aforesaid reasons, this writ petition is<\/p>\n<p> ordered directing that on production of a copy of<\/p>\n<p> this judgment, the first respondent    will ensure<\/p>\n<p> that    the competent  authority  in  the  Geology<\/p>\n<p> Department, having jurisdiction over the area, is<\/p>\n<p> contacted with a request to immediately ascertain<\/p>\n<p> the type of sand that is loaded in the lorries<\/p>\n<p> and thereafter, act upon in the light of what is<\/p>\n<p> aforesaid. This exercise shall be carried out<\/p>\n<p> within one week from the date of receipt of a<\/p>\n<p> copy of this judgment.
