Bank of Baroda &amp; Ors.,<br \/>\nreported in (1983) 4 SCC 491&#8217;.  Learned Advocate invited<br \/>\nattention of the Court to paragraph No.16 of the said judgment which<br \/>\nreads as under:\n<\/p>\n<p>&#8220;16.\tWe<br \/>\nthink that the application of the management to seek the permission<br \/>\nof the Labour Court or Industrial Tribunal for availing the right to<br \/>\nadduce further evidence to substantiate the charge or charges framed<br \/>\nagainst the workman referred to in the above passage is the<br \/>\napplication which may be filed by the management during the pendency<br \/>\nof its application made before the Labour Court or Industrial<br \/>\nTribunal seeking its permission under Section 33 of the Industrial<br \/>\nDisputes Act, 1947 to take a certain action or grant approval of the<br \/>\naction taken by it.  The management is made aware of the workman&#8217;s<br \/>\ncontention regarding the defect in the domestic enquiry by the<br \/>\nwritten statement of defence filed by him in the application filed by<br \/>\nthe management under Section 33 of the Act.  Then, if the management<br \/>\nchooses to exercise its right it must make up its mind at the<br \/>\nearliest stage and file the application for that purpose without any<br \/>\nunreasonable delay.  But when the question arises in a reference<br \/>\nunder Section 10 of the Act after the workman had been punished<br \/>\npursuant to a finding of guilt recorded against the workman, for the<br \/>\ndefect in the domestic enquiry is pointed out by the workman in his<br \/>\nwritten claim statement filed in the Labour Court or Industrial<br \/>\nTribunal after the reference had been received and the management has<br \/>\nthe opportunity to look into that statement before it files its<br \/>\nwritten statement of defence in the enquiry before the Labour Court<br \/>\nor Industrial Tribunal and could make the request for the opportunity<br \/>\nin the written statement itself.  If it does not choose to do so at<br \/>\nthat stage it cannot be allowed to do it at any later stage of the<br \/>\nproceedings by filing any application for the purpose which may<br \/>\nresult in delay which may lead to wrecking the morale of the workman<br \/>\nand compel him to surrender which he may not otherwise do.&#8221;\n<\/p>\n<p>1.1\t\tLearned<br \/>\nAdvocate for the petitioner submitted that in view of the aforesaid<br \/>\nclear position of law, the award and order passed by the Labour Court<br \/>\nis required to be quashed and set aside and the petitioner is<br \/>\nrequired to be given an opportunity to prove the misconduct of the<br \/>\nrespondent before the Labour Court.\n<\/p>\n<p>2.\t\tLearned<br \/>\nAdvocate, Mr.Vasavda, appearing for respondent states that in written<br \/>\nstatement, paragraph No.6 only about the departmental inquiry is<br \/>\nmentioned to the effect that in the event if the learned Judge of the<br \/>\nLabour Court comes to the conclusion that the departmental inquiry<br \/>\nwas not legal and was not in accordance with the principle of natural<br \/>\njustice then in that case the establishment (petitioner herein) be<br \/>\ngiven an opportunity to prove the charges levelled against the<br \/>\nrespondent before the Court.  He submitted that it is not mentioned<br \/>\nin the paragraph No.6 that in the event the Court comes to the<br \/>\nconclusion that the departmental inquiry is legal and is not in<br \/>\nviolation of principle of natural justice and the findings recorded<br \/>\nin the departmental inquiry are perverse then also the establishment<br \/>\nbe given an opportunity to prove the charges levelled against the<br \/>\nrespondent &#8211; workman.\n<\/p>\n<p>2.1\t\tLearned<br \/>\nAdvocate, Mr.Vasavda wants time to cite decision\/s in support of his<br \/>\naforesaid submission.
