Rahul Lathor son of Harikant Lathor.\n                 All residentof village- Pipra, Police Station Mairwa, District- Siwan.\n                 Versus\n                                                The State Of Bihar\n                                                      -----------\n<\/pre>\n<p>2   21.07.2011                    Heard learned counsel for the petitioners and learned<\/p>\n<p>                       counsel appearing on behalf of the State.\n<\/p>\n<p>                                  The petitioners are aggrieved by the order dated<\/p>\n<p>                       19.07.2008 passed by the Ist Assistant Sessions Judge, Siwan in<\/p>\n<p>                       Sessions Trial No. 221 of 2008 arising out of Mairwa P.S. Case<\/p>\n<p>                       No. 76 of 2007 refusing to discharge the petitioners for the<\/p>\n<p>                       offence under Section 307 of the Indian Penal Code.<\/p>\n<p>                                  This Court finds with the order of the Ist Assistant<\/p>\n<p>                       Sessions Judge, Siwan is very cryptic. Not a single reason has<\/p>\n<p>                       been stated for rejecting the application. The Court ought to<\/p>\n<p>                       have seen whether there is any allegation in the first information<\/p>\n<p>                       report which indicates that there was an intention on behalf of<\/p>\n<p>                       the petitioner to kill the informant and his family members. It<\/p>\n<p>                       would appear that the occurrence has taken place due to a fight<\/p>\n<p>                       of dogs belonging to the two families..\n<\/p>\n<p>                                  I, thus, quash the order impugned and direct the Court<\/p>\n<p>                       below should pass fresh order in accordance with law within a<\/p>\n<p>                       period of two months from the date of receipt of this order. The<\/p>\n<p>                       petitioners are directed to produce the copy of this order within a<br \/>\n<span class=\"hidden_text\">                                     2<\/span><\/p>\n<p>              period of one month before the concerned court, failing which<\/p>\n<p>              this application shall stand dismissed.\n<\/p>\n<p>                        This application is allowed.\n<\/p>\n<\/p>\n<pre>Md.
